Claim form - county court business centre
BREAKTHROUGH
Hello all,
Around 3 years ago on created a threat in this forum and received some very great advice from everyone here which helped me at every stage of the county court business centre process. I received a court date to appear in court, but a few days before the said court date I received a letter from the claimant withdrawing the case from the court. I was elated and very grateful to everyone on here who helped. Spoke to the court who confirm the case had been withdrawn.

Fast forward to Friday, I received 2 new claim form from the county court business centre. One for a pcn dating back to 2017 and another for a different car (I changed my car) dating back to 2019.
Before I was unsure whether I had parked where they said but on this occasion I am sure I parked where they mentioned and I park there regularly.
Firstly it is near my child’s school so it’s convenient and secondly it is the parking for customers of the shop which I always patronise when I do park there. Their sign states to ask for a parking permit but whenever I go into the shop and mention this, they know nothing about any permit. I also struggle to communicate with the staff as they speak little to no English unless another customer is there to translate.
I know I have to again go through this whole process of writing a defence etc but it’s frustrating especially since I always patronise the shop when I do park in order to avoid penalties yet still receive them.
Can anyone offer any advice of what I can do? Is there anyway to get out of this?
Thanks to all who reply in advance

What are the Issue Dates on each of your County Court Claim Forms?
The process hasn't changed much since you were last here, so you probably recall that the NEWBIES thread is your first port of call.

Issue date ??
Parking company ??2 -
Hello thank you for your reply, both claim form are from Parking awareness services and I guess the legal representatives are DCB legal.Redx said:Issue date ??
Parking company ??The issue dates are, it appears on one claim form there are two which are 03/10/2017 and 07/11/2017 and the other 07/02/2019.Never received any pictures. I did receive a couple letters but I honestly assumed it was an error or one from the initial claim.
I will definitely go back and read through the NEWBIES thread again. I am so bad at this but hopefully I will get through like I did the last time. It’s annoying because this time, I can actually say I used the shop so don’t understand why I keep getting tickets. SadKeithP said:What are the Issue Dates on each of your County Court Claim Forms?

The issue dates are, it appears on one claim form there are two which are 03/10/2017 and 07/11/2017 and the other 07/02/2019.@KeithP is looking for the 'Date of Issue' of the actual court claim forms, not the issue dates of the PCNs.From the dates, Keith will give you further advice on the deadlines you have to work to in order to meet the initial court timetable. We hope you will update this thread when the final outcome is determined. Disappointingly, despite lots of forum help, you left the previous thread 'hanging' with no outcome reported at the time. The only thing we get (and politely ask for) from giving our time and advice is to know how/if it has worked, otherwise what's the point of the hundreds of hours a month we spend here? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Those dates can't be right, They look like the dates of the alleged event. We need to know the issue dates of the claim forms.I married my cousin. I had to...I don't have a sister.

When I finally got access the thread had been closed. I am really sorry I was not able to update everyone but I did I try.Umkomaas said:The issue dates are, it appears on one claim form there are two which are 03/10/2017 and 07/11/2017 and the other 07/02/2019.@KeithP is looking for the 'Date of Issue' of the actual court claim forms, not the issue dates of the PCNs.From the dates, Keith will give you further advice on the deadlines you have to work to in order to meet the initial court timetable.
@Umkomaas @Fruitcake The issue date is the 15/07/2021.Again I’m truly sorry.3 -
The issue date is the 15/07/2021.
With a Claim Issue Date of 15th July, you have until Tuesday 3rd August to file an Acknowledgment of Service. Do not file an AoS before 20th July, but otherwise there is nothing to be gained by delaying it.
To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.Having filed an AoS, you have until 4pm on Tuesday 17th August 2021 to file your Defence. That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.3 -

Should I post a draft of my defence once done? I think I saw how to write one on post 5 on the NEWBIES thread if I’m correct.I’m currently ready through the NEWBIES thread. It’s a lot!!!Thank you again for all the help so far.
