    Hello
Just caught this thread while scrolling through the forum. I've been fighting UKPS over a PCN issued at this site last year and I'm going to start my own thread shortly to detail my experiences. The car park is managed by Johnson Felllows, Charter House, 163 Newhall St, Birmingham, B3 1SW and they employ UKPS to issue the PCNs.  Wing Yip & Halfords claim to have no involvement. You could try contacting them, though this didn't work for me. The email contact is chris.monteith@JohnsonFellows.co.uk.
Did you pay the fine in the end or go to court, did you win?
It's 7 months since that poster even looked at the forum. Suggest you send them a PM to see if they'll respond to you. I somehow doubt they will. But, unless you try, you'll never know.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Hi, Did you get the PCN sorted in the end, or did you receive any CCJ yet? Please let me know I am in similar scenario.

@msohaib13, it is nearly three years since the poster who started this thread, @poper, last visited MSE forums.

It might be a good idea to start your own thread about your own predicament.

    No-one here gets a CCJ.

UKPS cancelled it. Or didn't take any further action.

I have begun receiving a series of Debt recovery letters from agencies, threatening to take me to court(what is taking you so long...) if I don't pay. Almost four years since the incident took place.

Ignore the powerless debt collectors letters

Come back to this thread if or when you receive a Letter of Claim giving you 30 days notice,  or a court claim

    The deadline is 6 years

Received a "Letter Before Claim" from a solicitor company asking me to settle debt outside court. I am ignoring this and will wait for the court claim to be filed.

Why? That's not the advice in post 2 of the NEWBIES thread. Which solicitor?

Once you have responded to that Lbc by email and while your case is quiet, we kindly ask you pleeease to respond to the Public Consultation which is now open for August.

What parking operators do is is a national disgrace and a drain on Society, in terms of money and anxiety. If you want to be part of the push to change things in future, it's very important that people like you tell the Government that:

    a) you have no faith in POPLA or the IAS and that there must be a SINGLE APPEALS SERVICE that people trust. The sector is crying out for an independent and impartial appeals service - not two involved in a race to the bottom - that will give a real option to resolve disputed cases out of court. If there had been an impartial and fair ADR you'd have used it, etc.

b).  THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND OFFERING A 'PAYMENT PLAN' THAT ONLY THE VULNERABLE PAY. DRAS MAKE NO MONEY IF THEY HANDLE DISPUTES IN THE SPIRIT OF THE APPEALS CHARTER, WHICH IS WHY THEY PLOUGH ON TO COURT CLAIMS AND CCJs, RATHER THAN OFFERING REAL RESOLUTION AT THIS PRE-ACTION STAGE. THEY'VE OFFERED NOTHING, NO LEGITIMATE OPTION TO KEEP YOUR CASE OUT OF COURT.

c). Tell the government about your experience. It is clear that most profit is going to the third parties with no thought as to the interests of parking operators, landowners or consumers, which cannot be right.

Responses are invited to the Consultation now:

    Do it this month pleeease!

We will discuss it further next week on that thread if you want ideas.
