So if i cant provide them tenancy proof of £900 then instead of charging me an overpayment will the decision maker offset it against LHA ( £295 per week ) which is infact more than my housing benefit.poppy12345 said:If you're over 35 then you'll be entitled to the 1 bedroom rate of LHA for your area. No. If you can't provide proof of liability to pay rent then you will have an overpayment for all the amount of Housing element you've received, as previously advised.

The LHA is the max you are entitled to, you do not get that if you cannot prove you are liable for rental payments.
The LHA is not just a standard payment that everyone gets.
What you have been paid is what you claimed, if you cannot prove you are liable for this figure you will be liable to pay back all pf the housing element, and the LHA has nothing to do with it.
Forget about the LHA as it is pretty much redundant now0 -

How would the landlady stand if she has been letting out her spare room to the OP under the rent-a-room scheme? Is this liable for tax etc.? If this was the case could that be why she hasn't provided a confirmation letter to her lodger, as there's no need to?

It wouldn't be HB in this case, it would be the housing element of UC. I don't see that it being a rent a room scheme makes any difference to any other lodging scheme as long as the landlady will provide a document confirming the arrangement. Which is the sticking point here, possibly due to the landlady's not declaring what she should have been to the various agencies.

but I appreciate it's better to be correct for future readers.
I hope the old dear isn't being manipulated by her family. Can't think why else she would have said she doesn't want the OP to stay there anymore. I imagine it's comforting for someone of her age to know there's someone else in the house.

Some people struggle to state what they mean in a compact fashion or miss important facts out, this doesn't mean they don't genuinely need advice.
Also, sometimes things don't need to be challenged, just give them enough rope and they'll do the job themselves.
