yet another debt collector letter saying this time we really really REALLY mean it (honest)
I seem to remember that if you have proof you did pay, or are certain of winning, you can start charging the car park firm every time you receive a letter or have to reply to one
I'll email BPA if you think thats a good idea cheers0 -
just emailed NCP again, told them as their demands are vexatious we will charge them administration fees from now on

I expect NCP are having a good laugh about that.3 -
Agree the admin fee argument is a nonsense.
The correct argument is that continued debt chasing and threats of enforcemebt can constitute harassment where proof of payment sent and there is simply automated nonsense. That's on all fours with British Gas v Ferguson.5 -
OK maybe charging NCP admin fees is a bit silly. I like the harassment idea though
I've constantly told NCP that I've got proof I paid but they haven't asked for it. Maybe I'll just send it anyway - even though they've said they "can't" deal with it any more as it's been passed to their collectors
Now we've got a letter from a different set of scary sounding people who are threatening letters, emails, calls, SMS, which then could lead to a letter of claim and THEN legal proceedings. One wonders why they don't just go to court now hmmmm
So maybe I should just get the proof into them... I had up to now had some kind of "keep your powder dry" approach
All advice gratefully received0 -
You should be open with your evidence at pre-action stage; it looks better later in front of a Judge.
And stick around please, keep coming back and reading more:
Please do us and yourself (and the driving public) a favour and stick around on this forum every week - at least for the Summer - to ensure you see when the Government publish and open the final Technical Consultation.
We will be talking about it and the public will have about 4 weeks we think, to tell the MHCLG what you think about the level of parking charges, that the MHCLG has admirably decided already will start at £50 (50% discount) and not £100:
Outcome of 2020 Consultation:

Planned Summer 2021 additional Public Consultation:

It's not open yet but please keep check here to see when it is.
We need real people like you to counter the spamming that happened last time from the industry.

thank you coupon I definitely will, the scammers had been quiet for a while, but from now on I'll be "regular"
I will get the proof of payment sent in, so there's "full disclosure"
I will ignore the "we can't respond" attitude

ok I've sent the relevant screenshots direct and told them to get their collection agencies to do one or we will consider it harassment1

got second letter from solicitor giving us til a date in August, then "your account will progress to a letter of claim on expiry", does that even make sense?
Then they say "our client will take legal action to recovery (sic) the sum due"
I suppose I should send them the screenshots to show that we paid on the app? They presumably aren't stupid and will realise they aren't going to win?0 -
Yes reply again with evidence because it looks better to the Judge later if you made every effort to resolve it.
The Government Consultation into the level of parking charges, discounts, false debt recovery add-ons and the Appeals Charter (that should IMHO result in full cancellations not enrich the PPCs by £20 or more and encourage spurious PCNs that should never be issued) is now open!
