    That's not a little-known rule, it's in the HC which every driver is supposed to know. (Rule 239).

    He also seems to think I am "probably wrong" to say that Havering are not correct in implying that you cannot park within 1.5m of a dropped kerb.  Money-grabbing councils rely on gullible motorists like this to keep paying invalid parking tickets...
    That bit does sound ludicrous.  A general prohibition on parking less than 5' from a dropped kerb would preclude parking almost anywhere in suburban areas.  
  • Are we sure the situation isn't more akin to something like this?  The OP's car is the blue box, the red bit is a dropped kerb, the grey perpendicular lines are a drive, and the purple cloud indicates restriction to turning and access.  Sorry for the rubbish diagram!  
    How narrow is the road, OP?  And is there a dropped kerb opposite where you have parked?  
    Heya. It's wide enough for two cars to drive past each other no problem. Wide enough for the garbage truck and a car to pass each other as well. Yes, opposite is another dropped kerb (where I took the picture) but that's the case with the entire street. In fact, I don't think there is a house without a dropped kerb. 
  • Sorry, haven't had time to check the council photos yet as they usually take a day or so but will get round to it in a second. What's even dumber is that the allocated parking outside my house (cul de sac) doesn't allow for this gap to be honoured. For example, there's a disabled parking bay and if ANY car parks there, there is no way you can leave even a meter gap. Same with the marked spaces where you have to mount the kerb, the markings are well within 1m of a dropped kerb.

    Just checked the council pictures and I still don't know what they are getting at. It's near identical to what I took, only the front picture as a slight angle which makes it looks worse but still level with the beginning of the slope. Ironically, the picture showing the ticket clearly shows another car behind parked well within 1.5m of the kerb! 
  • If the council photos do not show any part of your parked car overlapping with that part of the kerb lowered to the level of the road, then the alleged contravention did not occur.  The sloping part of the kerb does not count as part of the dropped kerb.

    If the council photos show the same as your own photos, then I would make representations to the council that the contravention did not occur as you were not parked adjacent to a dropped kerb, and ask them to cancel the ticket.

    But rather than listen to me (I'm no parking expert) got to Pepipoo now.  I'll wager they'll save you from paying this ticket.

    Maybe you could post the pictures that were provided as evidence by the Council to support the ticket, and also that the car is the BMW 3/4-series convertible (not 2-series).  Certainly, in the pictures you posted, the perspective makes it look like the car is clearly longer than the gap between the two dropped kerbs.
