    Parking date - 21/05/19
    Letter of claim - 09/09/20
    Claim form issued - 26/10/20 (Date of issue 02/11/20)
    CCJ awarded - 18/11/20
    1st House move - 30/07/20 (Didn’t tell DVLA as it was a temporary move but was on the electoral role)
    2nd House move - 30/10/20 (DVLA have been updated with new address)
    1. What efforts did they make to find you ?
    2. Had they made any were you there to be found ?
    3. Was this clearly a university address ?

    2. I am not sure what you mean, sorry?
    3. Yes it clearly a University address as Lancaster University is a Campus Uni.

    1. Rather than assume, ask them.
    2. Had they made any effort, were you there to be found.
    3. That helps as any reasonable person would assume a uni address is short term.
  • I will ring them now. I was staying at university at the time but my car was registered back home to my mums address.

    So if it was registered at mums, 1. did she get a claim form 2. did she not tell you ?
  • I have contacted them and they state they don't have the information on how my details were obtained or what efforts were made. She said I need to seek independent legal advice and I bluffed her saying I had and that they told me to ask you those questions but she said she didn't have them.

    You need documents 
    This is court. Not a casual chat. 
    So no, it was not clearly a uni address! 
    1) They will have grabbed the RK address initially, presumably your mums. So, did you get that? Yes or No. 
    - if you did, then did you respond?
    - if you d id respond, when was the final time you responded?
    2) IF they had tried to find you, before filing the claim, were you on electoral register, had council tax in your name, had utility bills? Yes or No
    3) As pointed out, the address they would have grabbed for the RK was actually an address you could have picked up post from. 
    So, which address did they file the claim to? The RK address (your mums) 
    If so, why wasnt this known about?

    Email them to confirm the details of the call for use as evidence.

    I guess the next thing is to ask DVLA.

    My mum and I were not on speaking terms at the time. If she did open any of my post, she did not tell me. I have not opened any letters nor have I responded to anything. I was on the electoral register but did not have council tax or bills in my name as the house is my mums. I just lived with her. They filed the claim to the RK address (my mums).

    No, for 2) we are clearly not talking about your mums!
    We are talking about where you actually were living at the time the claim was issued
    Becuaae the claimant should have tried to find you, and we are trying to determine if you were easy to find
    Obviously, we are not talking about the address they already had.
