CCJ from parking ticket on credit file
Comments
-
I only know it is a parking ticket from ringing the courts after having found out about the CCJ. I vaguely remember seeing a letter about a parking ticket when I returned home from Uni for the holidays but due to not receiving anything else I just threw it away. My family back home never opened my post.0
-
And just to clarify the letter was not regarding anything relating to a CCJ.0

You need to ask the CCBC if they would kindly e-mail you a copy of the original claim form and a copy of the judgment, then you can start dealing with it by having facts rather than flailing around in the dark.0

Yep, calling the CCBC is the obvious step, to get info...1

Okay Thankyou very much0

Step 1
Get the claim form from the courts and/or claimant.
Step 2
Work out why you didn't get the claim form and form a timeline.
Parking date. Notice dates. Claim initiated date. CCJ awarded date. House move dates. Record changed dates it's.
You'll need to investigate and ask the relevant people.
Step 3
Within 3 days of discovery, ask the claimant for consent. Even if they say no, you've given them notice of intent.
7 days to answer chase after 3/4 so they can't claim to have not gotten.
Step 4
Application.3 -
I’ve called the courts. The CCJ is for £248.02 and the claimant is asking for the full balance. It is a parking fine from 21/05/2019 when I was at university and now I know the date I remember that I had an exam and was running late and there was no parking so I did park in a space where you required which a permit which I did not have.0

I have spoken to citizens advice and they have stated that a set aside would be a waste of money as I don’t have a defence for parking. Is that true?0
-
NO! CAB ARE RUBBISH! Noone said to call them.
Even if you lose any following claim, you at least have gotten rid of the credit destroying CCJ
Did you get all the details above?2 -

If the Judge subsequent to the set aside decides there is a case to answer in regard to the actual parking event, he/she will instruct you to file a defence for a later hearing, or ask the PPC to issue a new claim. He/she might decide to strike out the claim in its entirety. If you are not well remunerated via employment you are likely to be entitled to some (or all) relief on court fees for the set aside application. Check it out. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
