Umkomass. 1 question if i may. Mu good lady wants to know why she needs a SAR now? She says that if she asks for one, UKPC will know she has had a letter. Thanks.

She can ask for a SAR at any time. It was your suggestion that you would obtain a SAR.  Leave it to see if a court claim is issued if your wife feels more comfortable with that. 

We will not contact DCBL, but will get a SAR from UKPC.

A SAR is important so you can get the info they have on you.  This mail bomb by DCBL is because UKPC provided them with a list of names and addresses and ticket numbers. That is all DCBL will know so you will get info that DCBL don't have and don't know.

This is a stupid industry and the actions of DCBL is ill thought out and will cost them money and it will cost UKPC money.  Here we have a parking company who do not do very well in court and a legal who runs the same gauntlet.  

It is my opinion that the authorities should be aware of this and take action against DCBL. A few posts back, I said this
"Such intimidating letters must be forwarded to your MP with a request to pass this on to the FCA AND Robert Buckland MP, who is Lord Chancellor and Secretary of State for Justice.
Your MP should worry about how many of these letters are being received in his/her constituency asking for inflated amounts on an unproven debt"

This could well be the last attempt for UKPC to get money because they cannot make a living from a car park like this .... A UKPC car park ........

You submit a SAR to UKPC so that they have to send you all your data, which will help (if it goes to a small claims court hearing) at witness statement (WS) stage.  A CCJ will not APPEAR, you will receive a claim form from Northampton CCBC and will have to prepare a defence and a WS, attend a hearing and a judge will decide; that is the judgment in CCJ.  Even then if you lose, you pay it before the deadline set by the judge and it will not affect your credit.

Hi Team, please tell me if I need to start my own thread, but I assumed that this was the one to actually post on Same as everyone else, received a letter yesterday from dcb legal. I was made aware of this by dcbl last year, when they started sending letter. The actual 'offence' was committed back in 2016 and was for parking outside of my own front door (a sign was put up all of a sudden, stuck onto the actual wall of our flat - I have all of the photos via a SAR that I sent, after taking the advice of coupon-mad. I can attach them also, but wasn't sure if this would take the anonymity away, although I have already blocked out the reg, time, date etc.). Anyway, I have already sent SARs to the relevant parties, so I have all of the information and I am just looking for some advice/guidance as to where to go from here. Coupon-mad said that if I went to court and lost the maximum fines would be c£200, so it's nothing to really worry about. I also see that Terry Szmitd has now setup his own ltd company, so the claimant on the form is no longer correct and a sole trader cannot pass debt onto another company? However, I did look this up online and there is nothing, apparently, to stop someone from being a sole trader at the same time as owning a ltd company, so does this argument stand? Thanks, appreciate all of the help. You guys do a great job.

I have, of course, obtained the SAR from Capital Car Park Control ltd, so this implicates them in the sharing of data from a sole trader to a ltd company, even if they haven't bothered to update the name with dcbl. Just keen to understand what clear next steps to take; whether to inform dcbl, like I saw Mad Dog suggest to another forumite, or to contact my MP (again) etc. Cheers.

I notice you've contributed to other threads concerning Szmidt and the information and advice won't differ from those should you open a new thread of your own. Blackdog has got the bone between his teeth on this one (even though his paws scrabble all over the keyboard at times!  He wasn't much better when he was a cat!). 

However, I did look this up online and there is nothing, apparently, to stop someone from being a sole trader at the same time as owning a ltd company, so does this argument stand?

Blackdog asserts a position on this, @nosferatu1001 seems to have a slightly different take. As far as I can see, none of us is expert in company law and your research into company law is only as good as ours, and as this is your case, you'll need to put in the legwork to get to the bottom of it, then let us know the results. 

There have been previous Szmidt (sole trader) cases going back over a number of years here, and on PePiPoo and on LegalBeagles forum. The latter will be the better placed to answer your legal questions, as they have a number of legally qualified people regularly contributing there.

You say that you obtained a SAR from "Capital Car Park Control Ltd"  This is an entity and was only incorporated in August 2020 and Szmidt was appointed as sole director in August 2020

This is the angle I would like to take and assume is relatively safe. The contract was between myself and a different entity, not the person himself.
