So long story short I was working on a vehicle in the service station and I overstayed by 24 mins. I could not recall any signs .
Firstly the vehicle is a company one and second do I have grounds to appeal or do I pay? my manager has said we can't win them on grounds 'we were working on the broken down vehicle' on said service station anymore .
I have seen a sticky for company vehicles will that apply to me ?
The fine occurred 25/11/20
Letter dated 2/12/20
I was told today 9/12/20

Thank you in advance

  • 1: this is not a fine
2: was this a motorway service area?
3: where is/was this service station?
3: if the vehicle was/'had broken down then it was unable to move, your manager is wrong, also see "frustration of contract"

It applies to you as hirer or as lessee , if the NTH is in your own name and nobody else's

If it's in the company or lease or hire company , it's not your problem , yet

The best solution is a MSA complaint to WB or whoever runs it

No blabbing about who was driving , not to anyone , ever

If it's in the company or lease or hire company name still , it's not your problem , yet

The company should use the NTK PCN to name you as hirer or as lessee , as day to day keeper

The best solution is a MSA complaint to WB or whoever runs it regardless

No blabbing about who was driving , not to anyone , ever

My first question is to why your manager thinks you would not win. You were FIXING a broken down vehicle
Best tell your boss that he believes in a scam.
CPM just like all parking companies, are so desperate for money right now
You need to tell CPM the facts and request they cancel.  See what they say.
But as they are so desperate due to covid they will probably reject it.   No problem, you come back here for advice

I would keep your boss out of it, probably a nice guy but knows nothing

I would not be revealing who was driving !!

Do not let indignation get in the way or proper procedures

Follow the same process as in this thread

    https://forums.moneysavingexpert.com/discussion/6204252/i-received-a-pcn-for-my-work-hire-vehicle#latest

After your manager contacts the MSA and complains about one of his employees getting charged for helping a customer on site , doing their job

No names , no pack drill , no naming the driver , but laying it on thickly as disgraceful behaviour by their contractor

Your manager should remind them that they say the tail , not the other way round

Unusual if it's cpm , it's usually cP or PE or similar

Service Station = somewhere that motorists can stop to refresh/eat/drink? These exist on many roads, not just motorways, but for the purposes of a PCN then considering it as an MSA will provide relevant info when you search here.

Edit: All acronyms are explained in the NEWBIES FAQ sticky thread. If you can't find it, use a PC not a mobile device.

Yes to the first bit, no to the second but (that's not how to appeal to a Notice to Hirer).

And you've been told what PLAN A is and it's neither of the above.  The NEWBIES thread tells everyone what to do FIRST.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

To be 100% sure correct me if I am wrong. Also I might have led ypu to believe its on a motorway. I've edited the title accordingly. It was a 'A' Road petrol station .

1)Will get my manager to put the pcn in my name .

2)Then I will send the full template of the following over:

    Re PCN number:

"I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner."

(I've been trying to contact the fuel station but the number they have is not working !! )

So you go for Head Office, if it's a national chain.  They signed the contract.

As hirer , do not use the blue text template !!

Go to the bottom of the first post , read the advice by Edna basher and use one of the two templates , adapting it as required , appealing as a hirer , or as a lessee , which is as day to day keeper

You can add a one liner stating

The driver was repairing a broken down vehicle onsite with the owners permission

What you don't do is say I was repairing etc

There is no good reason to say "My , Me , Myself & I" at all

The urge to tell your story should be resisted !! Before you put your foot in gob !
