  • Maybe I am overthinking things but just want to ensure I do things right and should have asked first in hindsight but sounds like it will be OK

    Hey all,

    So I have a telephone hearing in June and working on my witness statement atm.

    Do I need to repeat any/all of my defences from my defence I had submitted? Or just tell the story of what happened, what I've tried and I don't need to reference my defence much because the judge will already have this to hand?

    I've seen some witness statements repeat the Beavis case, Abuse of process etc which would also be in a defence but want to know if I need to repeat some references to the leasehold about no parking permits required etc and primacy of contract of the leasehold and no mentions of parking permits in the lease etc

    Your WS should build from your Defence, told in your own words. Check out the exemplar by @ricky_balboa and use that as the framework for yours. Post up your draft here for critique before submitting it.

    Yes and no.  Don't call it 'abuse of process' as if that's a magic phrase.  It's a horrible legalese phrase because people last year got all excited and bandied it about yet didn't understand it.  More important is what the Govt had to say about the false added debt recovery fee and that's now in the New TEMPLATE DEFENCE.  

    You are not at defence stage but CAN borrow wording from the template defence about what the Ministerial Foreword to the DLUHC's new code says about the fake added 'costs'.   One example of someone who did this is rickybalboa, whose full username was given as a link above.

    Hi all,

    Have taken some time to try ensure my WS covers everything and think it's pretty much done now. However before I decide to post it here, should I not be worried that the claimant or their representation might get a good preview and then base their current statement on this?

    Just wondering if I need to share this more cautiously (perhaps by sharing via DMs or something) for now until the hearing is done or would this not really give me any benefit at all?

    There are one or two points in it I'd rather not display right now and m but it would only be a few points to which I'd rather not elaborate any further on at the moment as to my reasons if that's OK :smile:

    No-one has time to handle basic stuff like draft WS, I'm afraid.  We spend half our life on here as it is!

    Check out the one by wobs2k and if yours looks like that bundle, then you are getting it right.

    Yes of course I have redacted my draft but the scenario/case could still possibly be identified them if they review these posts all the time. 

    And because of this, this is why I was wondering if its OK to do so without jeopardising your own case.
