Once the CCBC DQ is in the post and on its way ( or arrives ) , as shown in your MCOL claim history , that is when you download it , fill it in , and email it to the ccbcaq email address , same as the defence , checking for an email auto receipt from the CCBC , also copying in the claimant's lawyers ( or claimant ) as well , so one email , 2 destinationszimbo_ouen said:Ok thanks @Fruitcake
Out of interest the Directions Questionnaire from the CCBC, should I fill that out and send it to them pre-emptively or wait until they send one to me and then send it back in reply?
But yes I will ensure I read through and double check what else I still need to do in the run up. Thank you all
You are following the 12 numbered steps in the defence template post4 -
Hi all and hope this finds you well
So I have now received the CCBC DQ and read through the guides, but still don't see an exact answer of the "why" of what to put for D1 = name of your local County Court
The guide states "– unless you are a Limited company, the case files will be transferred there. They will ask for theirs but protocol dictates it is your court."
So for the reason why do I just say it's my right? Or can I leave it blank as this protocol just exists and they will just accept my venue request?
Also wanted to check on D3 - Witnesses
I'm thinking I need to put 2 - myself and my girlfriend who is the owner of the leasehold and parking space I was given a ticket for - but wanted to check if this is for specifying in-person witnesses I intend to have at the actual court hearing or this also covers a written witness statement by her only, and she won't need to attend physically at the court?
Thank you in advance

I don't believe you need to state why you want the case held at your local court, but you could always just put that it's the one that is nearest/most convenient for you.
The number of witnesses helps the court decide what size room to allocate for a face to face hearing. Putting 2 will be fine. Make sure she also writes her own witness statement, signed under a statement of truth.I married my cousin. I had to...I don't have a sister.

Yeah D1 does ask for the why:
"At which County Court hearing centre would you prefer the small claims hearing to take place and why?"
I'll just make it as obvious as the fact my selection is nearest to me
Thank you @Fruitcake for your prompt reply and help

So I've recently had a letter from BWL with their service copy of the DQ N180... and they've requested Mediation?
I'm saying no still don't worry but should I read into this or they always try this first?
I'll be sending my ones back tomorrow. What happens if One party says Yes to Mediation and the other No? I assume it must default to a hearing then right?0 -
No mediation will take place.zimbo_ouen said:What happens if One party says Yes to Mediation and the other No?4 -
I have now sent off my DQ N180 form and have received the confirmation of receipt auto response from the CCBC QA address. I copied in the email address of the claimant's solicitors address they used in their DQ N180 form - hope this was OK to do as it made sense to use this one if they've supplied it to the courts for this case

Thanks Keith P
Just as an afterthought - I hadn't seen anywhere on what to specifically put in the subject of the when sending the N180 form to the CCBC QA address and I went for something logical - "DQ Form N180 - Claim No: XXXXXXXX"
I'm hoping this is acceptable but if it's not please do let me know0 -
You're over-thinking things
nothing wrong with what you've done, the key part being to have the claim ref. there. Jenni x3
