Help please!! DCB legal court claim received
Comments

"I also have photos of the state of carpark and water and oil. I ignored all the debt collection letter but now received a court claim."
Those will be very useful for your WS.
What are people suppose to do in inclement weather, stop at home because the car park is waterlogged.
This is a weak case and the ticket should have been cancelled on appeal to the PPC.
These claims seem to becoming more and more trivial.

Worcestermum said:Thank you so much for your help. It’s all new to me as not experienced anything like this before. Partner is saying just pay up because of the evidence they have and increased court costs added etc and is it just easier l pay the £244 now however if you think it’s worth defending then I will

They have a picture of my car over the line, picture of my ticket i displayed, picture of the sign which is in tiny writing and cant work out what it says on photo, a picture with the parking ticket attached to my car.
The carpark is on Caroline Street Birmingham B3 1UF

Also to add the picture they have of my car going over the line you can see the line is not very clear have of the line is missing and also the other side you cannot see the line at all because of the massive pool of water which is why i parked slightly over. Also to add the way the carpark is laid out so that the space i was over into, is that small you would never ever fit a car into it, even if i was not over at all. Not that this would matter as still over. In the pictures you can also see the massive pile of bricks thrown all in front of the spaces.3

August 2020 and March 2017. (March 2017 looks pretty bad).
Looks as if they had to close if off at one stage. It's a scutty little car park.
The PPC will show the car park at it's best.
Whereabouts were you on the car park?

In August 2020 after they were suppose to have repaired the car park there still looks to be a pothole on the left hand side at the end. It looks as if water has collected in the hole even on a dry day.
These images will be useful for the WS especially the March 2017.

That first picture is exactly how it was when I parked with all the bricks in the corner. You can see all the bricks in the pictures they have took I was the one space in from the end where the bricks are in top right corner. Left side of car park. Apparently according to the lady who has the shop opposite said he relined it all in about June time which is after I had the ticket and now the Google image represents it a bit better.3

On the satellite image of the car park the white lines do not look as if they have been repainted and there are weeds on the car park. It's 2020 but not sure if that is the capture date of the image. From the satellite image some of the spaces don't look exactly the same size.
Is there a space at the end? I can't work that out. It does not look wide enough to park a car.
The image from 2017 shows the car park very wet however the pavement is not wet so the water must lie on the car park. If it was raining on the day you parked then it may have been worse than in that image.
I would use those images in your WS. They show how badly the car park has been maintained. I would comment in your defence how badly the car park had been maintained. The images will certainly support that point.

So on the above image you were parked on the left hand side, at the end next to what does not look like a space. Were you over the line in that space at the end? From the satellite image that does not look like a space. It does not look big enough.

Yes thats correct. I was parked one in from the end and was slightly over the space on the end but as you say there is no way a car could fit in the end space. A bike maybe but even a smart car would not fit in due to the angle and tight space. Thank you so much for all of your help i really do appreciate it. I have just finished my defence so submitting this evening.2
