Help please!! DCB legal court claim received

Hi everyone! Totally new to this forum. I have read the newbie thread however just wanted to clarify a few things. Parked in a private land car park, paid for ticket however car park was badly waterlogged due to bad weather back in February. Due to the huge puddle and oil in the water car was parked slightly over the lines to enable to get out of the car. Other side of the car impossible to get any car in space as space is so tiny and even a smart car wouldn’t fit in the gap. A sign was in the car park however in very small writing and didn’t see upon entering car park. Appealed to company however had reply saying I should have parked somewhere else if I couldn’t park fully in marked bay. I know somebody who works in the shop opposite car park and since this has happened has all been remarked as lines aren’t clear. Evidence has been sent to me from car parking company and you can see my car is parked over the line slightly. I also have photos of the state of carpark and water and oil. I ignored all the debt collection letter but now received a court claim. Should I try and defend or should I just pay up now to prevent further costs being added. Original fine was £100 now asking for £244

    No further costs will be added , the figure claimed is in front of you and in your post above , £244

    A loss in court will be less because the PPC has added spurious charges already, so defend it

    Name the parking company

    Email a SAR to the DPO at the PPC and attach a copy of the claim form as proof of I D under the GDPR law , to obtain all your data including documents and pictures etc

    Post the issue date from the claim form below

    1: YES you defend because DCBL are scamming you with a fake amount added.
    The max for a claim on £100 will be no more than £200.   Guess they have added their usual fake of £60 to £70 
    2: You have pictures to prove your case.  Doubtful DCBL would have these because they bring claims they know nothing about 
    Did they send pictures ?

    Even at this stage, you can still ask them for their legal authority to add a fake amount, if they refuse you ask the judge.
    Advise them you have pictures of the flooding that you will show in court

  • The ppc is premier parking logistics. No Dcb legal haven’t sent the pictures it’s premier parking logistics that sent the pictures when they rejected my appeal. 
    Issue date is 20th November 2020. I have submitted an extension yet as wasn’t sure on what to do. Have read the newbie forum with instructions so will do that today and also email the SAR request to premier parking logistics. Shall I send a sar to Dcb legal also?

    A SAR goes to the DPO at Walton W , not dcb legal , email it with a copy of the claim form attached ASAP

    Do the AOS on Thursday or Friday , not yet, do it online but do nothing else , no typing in the defence box , you will be emailing it in a few weeks time

    So do not do the AOS yet , it's too early
  • No the pictures doesn’t show the flooding however I took my own pictures so you can the large water puddle. Maybe I shouldn’t of parked there but my thought process was nobody was going to fit in the space on the end as teeny tiny and not possible to fit a car in plus lots of rubble bricks etc in the space on the end so I thought I move out over a bit so I could get my daughter out of the rear of the car. If I defend and loose when it gets to court will I get a ccj if I pay the costs owed straight away? 
  • The pictures premier parking sent me was a picture of the ticket on my dashboard a picture of my car from the rear so you can see I have parked over slightly over the line and a picture of the sign that’s located on other side of carpark in small writing and even looks blurred on a photo from close up.  The markings were not very good and as mentioned previously it has been remarked since and from photos you can only see quarter of the line as rest has faded away. They didn’t send a picture of the left side of the huge puddle

    Good evidence for Court , frustration of contract due to poor maintenance and adverse weather conditions springs to mind

    Plus you paid for parking , so they had their money , so no bilking

    If you lose in court , pay up in full , promptly , to ensure that the CCJ is expunged and does not affect your credit rating at all, you are given up to one month to pay the claimant , but the sooner the better
  • Thank you so much for your help. It’s all new to me as not experienced anything like this before. Partner is saying just pay up because of the evidence they have and increased court costs added etc and is it just easier l pay the £244 now however if you think it’s worth defending then I will
