ECP DCB Legal court claim

27. The Claimant failed to offer a genuinely independent Alternative Dispute Resolution (ADR). The DLUHC Code shows that genuine disputes such as this should see PCNs cancelled, had a fair ADR existed. The rival Trade Bodies' time-limited and opaque 'appeals' services fail to properly consider facts or rules of law and reject most disputes: e.g. the IAS upheld appeals in a woeful 4% of decided cases (ref: Annual Report). This consumer blame culture and reliance upon their own 'appeals service' (described by MPs as a kangaroo court and about to be replaced by the Government) should satisfy Judges that a fair appeal was never on offer.

OK so I'll check the para numbers and pagination then email it to: ClaimResponses.CNBC@justice.gov.uk
Right?0 -
OK, I have sent it. Thanks to all those that assisted and advised.
Merry Christmas, happy New Year and I'll see you all on the other side.2 -
Other than an acknowledgement from the court, I have received nothing else. Do they have a limited time to decide to proceed?0
-
Nope, it depends on the court's backlog. Could be months.
Just keep logging in once a week to see any updates.2 -
DCB Legal emailed me to advise that they well be proceeding. They have given a phone number to call to discuss settlement. Should I call or ignore that? I'm guessing you'll say ignore0

OK. I didn't want to be seen in bad light by the Judge for not being willing to resolve but I guess they will offer a small discount at best.
It looks like a day in court is on the cards0 -
mediation is or was the chance to resolve , some people have recently offered £10 or £20 and its been accepted
a day in court is a long way off in the process, a lot get discontinued along the way, so I suggest you read a lot more threads, including the tally thread by Umkomaas, its up to around 475 and counting2 -
