Common sense prevails at last. I was never going to be intimidated into paying £300+ in respect of an alleged breach of a contract which your client frustrated through the payment machine in their car park being unavailable.
Given that my partner suffers from anxiety and panic attacks for which no allowances were given, further that no allowances were made in respect of Covid restrictions in place, the whole case was simply frivolous. To pursue me for almost 6 years for a perceived overstay of 1 minute 53 seconds, under these circumstances was simply outrageous.
Can I please ask you to disclose what the total cost was to your client in respect of this matter?

They won't divulge it but the total cost to the client was £35. The court fee (almost certainly 'fronted' by the law firm) is then deducted from monthly returns.
You can see why parking firms do it.
Think of all the people who give up and pay £275 or so, or sadly get walked all over and succumb to £180-£200 'offers' at mediation or when harassed by phone, of which the client gets £135 a pop.
Yes… they bank more than the PCN face value, which offends against public policy.
Even offsetting the £35 wasted claim filing fee losses (with maybe about 1% or 2% of claims discontinued) the client still banks a fortune.
We think (on default judgments or claims paid in full) the legal firms appear to keep the interest plus £50 'legal fees' plus a half share of the £70 fake fee. So they too make three figures on an average case. FAR more on a multi-PCN claim.
