    If you get your insurance involved, they will get it repaired by one of their authorised repairers, or maybe even BMW. They will then try to claim from the other party's insurance. If he continues to deny it, and the CCTV footage doesn't actually show the impact, the claim may fail. Your own excess will then come into play and it will be a claim against your policy.
    Depending how much your excess is, it may be easier to negotiate a payment of less than the quote from the third party and then get it repaired by BMW at additional cost to yourself?

    He presumably has no idea what the footage reveals. So call his bluff. Tell him you have CCTV footage of him causing the damage, give him a set time to pay, then go via your insurance. He's already told you that the claim will affect his premium severely due to previous claims, so you hold all the cards here.
    No free lunch, and no free laptop ;)

    Do you have all of your message exchanges in writing? If you got some of these communications that you could pass to the insurance company, that would certainly help your cause.

    I would most certainly be taking it down the insurance route. He obviously wants you to buy a second hand mirror, and have it pushed back on by 'Bodgitt and Scrappit', one of the back street garages. 

    You're obviously only entitled to return the car to  pre-accident condition, but from what you've said, that's all you're asking for which seems quite fair.

    How should I proceed?
    Contact your insurance company, give them the details and the footage. It's what you pay them for.
    A video of the truck passing and an audible bang at the right moment should be sufficient for his insurance to accept liability.
    If you want to report the failure to stop after an accident, call the non-emergency police number but they'll probably not do much.

  • If you have evidence of him offering £300-£400 then that would be an admission of liability also; otherwise why would he offer that much?

    You need to inform your own insurance company no matter what happens.  If you do not you will probably be breaking the terms and conditions of your insurance, and that could affect the validity of any future claims.  
  • Update -
    I was intending to inform the police and insurance company when I had finished work today, as per advice on here however have just had the following message from the driver -

    'ive informed my insurance today, sent them the video you have of my truck that doesnt show it hitting your car. You can contact them via motor insurance database i also went into the store with the car park and he said you was lying about the video, which makes me think theres something strange going on. As i said need to see me hitting your car not just driving by you have my lorry reg please contact your insurance as i have today store was not happy today with what you have said not good my friend as i said i never hit your car my friend'

    He is changing his story now and I have on a text message from him saying '£600 was too much for the repair' and both myself and cousin heard him admit his guilt on Saturday.
    He also called the Garage I got a quote form,  prior to my actual visit as he had put up scaffold for them and to try and get a better price before he knew they would quote £600 exc labour.

    I will continue to proceed with the police report and insurance claim...
  • Most cars with 'wing mirrors' are in museums now.
    I always wait for this kind of response whenever anyone refers to 'wing mirror'.

    It makes me wonder if some people actually do scour the interweb forums for things to correct people on :D.

    They can't wait to pounce on "road tax", "car tax" either. It must feel very self satisfying to correct that.

    I sit here thinking come on, REALLY? I know i can be a picky sod but we both know what we're talking about here.

    These people must have a field day with old folk. Many that i knew when DVDs started becoming more mainstream would still refer to them as 'tapes' and again when DVD recorders became a thing, the older people i knew would say 'taping' still.

    I knew what they were referring to so just accepted it. Maybe it was wrong of me and i should've lectured them instead?
    I rather think that that was Fred's attempt at facetiousness.  
  • Sounds like he's trying to rattle you.....as I said earlier if you have cctv/video of him driving past your car and then hear the impact that should be good enough
