    Excel v Wilkinson

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    and copy the correspondence to the SRA, it is time they put a stop to this deception by an officer of the court. .

    Do not give the your telephone number.   The rest seem harmless enough.

    I would say as much of those as possible except for the telephone number , especially anything in bold !!

    I would setup a Gmail email address for this task and authorise that one , not my main email address
  • Ok so I had back the SAR from the parking company. The information is no different than the emails already been sent. They haven't submitted the conversations between me and the marina? I would assume the marina themselves would of contacted them? Am I allowed to be privy to those emails? If they exist?
  • What I do find confusing all the signs state the first hour is free. None of them state that the free hour should be still ticketed. I've attached my own photos of the site signage.

    Terrible signs. It states payment instructions, but clearly if there is no charge, you would not expect to need to do anything.
    The emails between you and the marina are of course not part of what they would disclose. 
    Emails between the marina and them, which gives your personal detail, sholuld have been included. But you have no idea if they exist. Id SAR the marina...
  • Yeah its very confusing. The ticket machine gives no explanation on how to obtain a free ticket. Their signage does not state that I need one. I read the free hour and left. Had every intention to come back within the hour and got stuck by the steam train, as documented and confirmed by the station itself.
    A relative stayed there the day before and left within the hour. They did not purchase a ticket and have not been issued a penalty. Am I in my rights to request that data with the known VRN?
    I will also SAR the marina and see what they have between the PPC and the marina.
