    Hi patient_dream,

All letters received and signage at the time were "Capital Car Park Control" and no mention of Terry until years after when he made himself director of the LTD in 2020, as you say.

I will raise this with my reply on 29th Dec as per Coupon_mad's post.

I shall ask for proof of contract with name included and also proof of signage that clearly shows Terry Szmidt T/A Capital Car Park Control LTD.

The name on the supposed contract and claimant will obviously not match.

The reason for my suggesting is quite self explanatory

How can DCBL be so stupid to assume that the claimant is Terry Szmidt when he is not visible to the general public

A judge is going to rip DCBL apart if they continue this rubbish

The workings of DCBL must be investigated by the SRA because this is plain stupidity and not in the interests of the public

My question is, does the boss of DCBL actually know what his staff are doing and the rubbish they produce .... or is he the leader of such rubbish ?????????????????????

He was. It was clearly shown on the BPA AOS list showing CCC with him as a sole trader. Both the DVLA and the BPA would have audited him as a Sole Trader.

    @Grizebeck

Not quite sure what your DRO / Breathing Space approach is trying to achieve. Breathing Space doesn't stop court action that has started, just the enforcement of any judgment.

And a DRO is a expensive way to get rid of debts - assuming someone qualifies in the first place.

By all means, it can be tried but can't see legal professionals being suckered by that approach.

    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
    • All land is owned. If you are not on yours, you are on someone else's and their rules apply.

A DRO in the right circumstances is an extremely cost effective way of dealing with debts up to 30K
A fee of £90...... not sure where you get expensive from.🤣

What it simply does is gets the case put on hold for X amount of time.

£90 is the fee. The cost is in the effects on your ability to raise credit later; the cost of that credit; the ability to rent; the amount you have to pay for accomodation; the disruption to lives while not have access to normal banking.

Spend some time with people who had a DRO and you'll find they've not been laughing at all.

Also you'll not know from the information on here, if a person qualifies. It's a tight specification even after the limits were changed. Not a recommended way forward which is why Breathing Space was brought in.

People who do a DRO will already have  credit issues. Its essentially a mini bancruptcy. People in such debt are not worried about overly worried credit etc.
It is for a lot of people a huge weight of their shoulders. Weighing up between credit file or no debt its an easy decision.

But the point here is missed. I am not suggesting for a minute they go down this route. It is simply a tool to delay until the cases become statute barred and then its game over

By googling Novation agreement you will see that that agreement is simply changing the name of the entity that has a KADOE agreement with the DVLA from Capital Car Park Control to Capital Car Park Control Limited.
