You don’t ‘absolutely need to do it’ but using any delaying tactic may push some of their PCNs past the 6 year mark. Many of these people at these companies are not very bright and the roboclaim nature of their business model may result in delays which may benefit you.

If you don't do it, the October one will be included in the inevitable court Claim, which they will be able to squeak in, just in time with two weeks to spare.

No replying too soon (plan your timing very carefully and slowly) but CERTAINLY don't miss the chance to kick the October 2016 one (possibly more than one of them) into touch, with one well-timed and worded email!

    So let's see...

28 days from 24th August is 21st September.

Add the 30 days seeking debt advice and it puts me at 21st October - 6 years and 3 days!

    Is that right? 🤔

"Dear Driver and Vehicle Licensing Agency,

provide KADOE contracts for capital car parking, capital car parking ltd. What date did you first grant them access via elise?"

This looks interesting, i just wish it was in layman's terms for me

    Out of nowhere.

Mr Szmidt obviously wants some Christmas spending money.

What steps should I now take?

On 29th December - NOT EARLIER! - email and ask for evidence of something (pictures of the contract = the sign). Obviously you only have to play email tennis for 6 weeks in 2023.

DO NOT accept a reply in January then think it's safe to leave it.  It is not.  Be reactive and proactive.

This is potentially worth £500 to you (not that you are likely to lose in court but a claim is a pain) so take time out during January to see this past the 6 year deadline (without saying that, of course).

You MUST keep the ball in their court to keep supplying you with some evidence, then something else, etc., until these time out.

You need to start thinking about a Defence.
What else does the second post of the NEWBIES thread suggest you do at this stage?

This is a long thread so excuse me if you have answered the question.

DCBL claim that the creditor is Terry Szmidt trading as ........ Capital car park control

What did the signs say? and if there is a contract, what does that say ?

Did any sign say or mention Terry Szmidt
Did the PCN mention Terry Szmidt

Or did everything relate to Capital car park control ?
Terry Szmidt made himself sole director of Capital car park control LTD on 24th August  2020. Terry Szmidt still had previous control of all data collected whilst he was a sole trader

DCBL suggest that Terry Szmidt did not sell or transfer.  Why would he, he already had the data.

I think this is beyond the county courts, more so a fraud investigation into Terry Szmidt and no doubt DCBL

@Coupon-mad i would do something slightly different and say this and send a few days before the deadline

    Dear Sirs

Having taken debt advice I made an appointment with a debt charity to go through my debts as i owe in the region of 18K, they have advised that a Debt Relief Order would be the most appropriate action and therefore this is now being instigated as this will nullify the debts i have and the parking notices will be included in these

It would therefore seem a waste of money and time for any court proceedings to start on this matter then these items would be included in the DRO even if a claim had been issued

The application will be completed and sent to the official receiver on the 6th of February to the Official receiver as i am sure you are aware this is done through an intermediary only. My appointment has been confirmed for the above date

I therefore expect to be in receipt of the DRO around the last week of Feb and will forward it to your on receipt for forwarding to your client.

    Regards

    .xxxxxx
