Yes, the tenant can't remain as it is uninhabitable. The local authority council tax visited today and gave me a 12 month exemption because he judged it uninhabitable.
I would have had a duty to find temporary housing - had my tenant asked. Just for the week remaining until the section 21 ended the tenancy. But as the section 21 ended the tenancy on 8th and the tenant is living elsewhere now.
If the tenant is living elsewhere, my duty ended. She will be making herself homeless from that address not mine.0 -

Yes - the charitable trust found the tenant and holds the deposit.
I'm just back from seeing the flat, counciltax guy, loss adjuster and surveyor.
No reference would have found the daughter's problems.
It is going to crown court. She apparently set fire to her fathers home the same day!
How are you after seeing the flat?

I was checking to make sure I had the keys to the flat before I left this morning. Then I remembered I don't need them - there have been lock changes and the door broken in and boarded up by police.
All I needed was a claw hammer or crowbar!0 -

Thanks for keeping us up to speed cgw. Seems like you are taking control of everything so good on you and whilst I am very sorry for your plight it is a learning curve for me as a landlord to watch and learn how things are panning out so I thank you for the updates. Keep strong, sounds like you are doing a fab job in very difficult circumstances but you've had lots of useful advice from posters on here.
I really wish you a speedy refurbishment and a trouble free rental in the future.0 -

Only reason i ask is i was told that a tennant had every legal right to remain until a court had ordered them to leave? The section 21 isnt enough.

If she was claiming to be homeless from your flat she would be intentionally homeless as it seems she was involved in burning it down.
She is not homeless she has found somewhere else to live,if she is becomes homeless from wherever she is now she could make a homeless application from that address as this is the address she last lived at, this would be her best bet because from this new address she may not be intentionally homeless unless, of course, she burnt this down as well, she does seem to be on a bit of a run!!
If she in intentionally homeless the council do not have a responsibility to rehouse her. There is always some do gooder about who thinks everyone should have a home, but if the coluncil keep housing her in these circumstances there seems to be a good chance that in about 5 years time they will have no housing stock left to house anyone!Loretta0 -

I never said they were i was just getting a little confused so asked for clarification(sp?)!
I'm glad the LL doesnt have to deal with them and house them. Just wanted to understand it all.
