I go to the flat tomorrow. I will actaully see it for the first time since the fire!
I will meet the freeholder there, the loss adjuster, builder and council.
I had a call from a someone in a refuge who is representing my (now) ex tenant.
She wanted to know about collecting her possessions - to which I replied that as I said in my text, she could collect them on Friday. After that, I said, she would have to make arrangement with whoever is project managing the refurb.
I said that this woman is no longer my responsiblity.
Then the refuge woman said that she had someting else to ask. My ex tenant wanted to know about her deposit. Was there any money left in it?
So I said that a video inventory was taken of the condition of the flat at the beginning of the tenancy and the flat, having now been burnt out by someone to whom the tenant gave key, in no way rese,mbled the original condition.
Then I felt upset, annoyed and indignant that no one seemed to recognise that I am an actual victim of arson. The case is going as that to the crown court.
I told the refuge woman that I didn't want her to contact me again, or speak to the ex tenant, or know where she is. I said that I would leave a phone number of whoever is dealing with the refurb and that was all.
And i don't expect to hear from them again.

I'm getting a a bit confused by the involvement of the trust. They seem to have been the front end dealing with the tenant, holding the deposit, making the videos to compare condition at the end.
In which case why is the tenant's representative dealing directly with you over asking about the deposit? Why isn't that going via the trust?
What scheme have the trust put the deposit in and what have they said about it's return? Have they agreed it all goes to you or do you now deal with the scheme directly?
I would make them do the checkout video, independent evidence of the condition may not be needed but still worth having just in case.
Come to that why were you ringing the tenant about the S21 directly, didn't the trust do it? It seems like the trust is acting as agent for you but only partly which is confusing.

From what it sounds like here, the "trust" is responsible for finding private landlords and holding deposits like "let only" via a LA.
if they are supposed to have refrenced, find out what thier scoring/gading process is. No referencing will really find out ( unless somone has been evicted before) that thier daughters are a nightmare, or that this tenant has a history of giving keys to others.

So if a place burns down you are no longer liable for them? I am a little confused on why u dont need to carry on with cout order unless the fire excludes them from your responsibilty?

Yes - the charitable trust found the tenant and holds the deposit.
I'm just back from seeing the flat, counciltax guy, loss adjuster and surveyor.
No reference would have found the daughter's problems.
It is going to crown court. She apparently set fire to her fathers home the same day!0 -
As I understand, the section 21 is a end to tenancy. But if the tenant decides not to leave, you have to get a court order to get them out.
In this case the tenant is now not in the same county. Apparently in a women's refuge.
So she has left.0
