    This is basic stuff.

    The Defendant is the keeper of the vehicle, right?

    The Defendant is being pursued as the keeper.
    The Claimant has to prove that they have followed the POFA sufficiently well such that they are able to transfer any driver's liability to the keeper.

    No they won't be asking anyone to produce the driver

    The defendant must defend herself as to why she has legal liability , or not !!

    If the claimant parking company has complied with POFA , then they can , will and do pursue the keeper , they won't care about who was driving. POFA compliance would mean that she has a legal liability to defend or lose , in her own name

    It is NCP who are pursuing it , not b w legal !! B w legal are doing what their client tells them to do , and their client has cashflow problems as seen on the news recently , so are taking old invoices to court

    And the bottom line is that Roboclaim firms don’t actually spend much, if any, time looking at ANY details of the case or defence at this stage as they know shedloads if people will read the letter criticising their defence and saying the victim should pay up, and will believe it, phone them and settle.

    It’s a case of who blinks first and they won’t blink yet.

    @Coupon-mad. it is really Roboclaim. I was thinking it is these cut and nail solicitors like bwlegal and Gladstone solicitors that go around looking for parking involves in order to make money. well, we will be seeing them in court if possible. I rmr my own parking ticket case, which you guys help me all through on this forum. it eventually went to court and the judge didn't even look at me, he started having a go at the parking firm solicitor for bringing me to court. I felt sorry for the solicitor. 
    @Redx and KeithP let NCP keep pursuing us. I am very confident we will win, as long as I follow your advice on here.

    The CCBC email address is listed in the defence template thread , because it's the same address as where your defence went

    yeah the address is correct. thats where I have sent it to. but it hasn't been updated on money claim online. why is that pls? this is beginning to worry me now

    If you sent it on Friday 16th, today is Monday 19th, were you expecting them to be working over the weekend?  Often the updating is a good few days later than the actual date of receipt. They are inundated!

    Have you thought about phoning the CCBC, they'd be far better placed to give you specifics than some random thoughts from a parking forum, which has no access to your records?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Possibly delays at the CCBC ?? They don't work weekends , check every day this week
