So Euro Car Parks rejected my appeal and I am about to submit my POPLA appeal, but at the very start of the appeal (Step 1) I am unsure which options to select.  There is no advice about this bit on the Newbies thread.

    Can anyone advise me here?
What?? No advice about PoPLA in the NEWBIES thread? Is that what you are saying?

If so, you need to read the third post of the NEWBIES thread where you will find great detail on how to create a winning PoPLA appeal.

No, I've already written out my POPLA appeal using all the advice in the Newbies thread, but as I have started the online appeal at POPLA, I've gotten to stage 1 and found that I don't know which option to choose from the ones offered.  I can't see any advice about this part in the Newbies thread....

My best guess here is to choose "Other"...  but I don't want to guess.

    No need to guess.   :)

In that NEWBIES thread it says:
...don't feel you have to answer their questions, you should write a detailed appeal and attach it as a PDF...

Later in that same NEWBIES post it says:

  • Thanks Keith.  I saw the part that said;
"don't feel you have to answer their questions..."
I hadn't been able to find the other part you mention above.  Thank you very much!

I don't know if you can cite cases in a POPLA appeal however one decision that you may find useful is the decision made by Henry Greenslade in the case below. This was not a court hearing.

It's an older case but still relevant. Henry Greenslade was head of the council equivalent of POPLA when he made this decision. It may have some influence on a POPLA appeal.

Thank you.  I had already submitted the appeal but that could be useful for anyone else reading this, or perhaps for me at a later stage...
  • Hi Harry ,
Had same problem , at Greengate on 18 July 20
Have photo of machine and appealed to POPLA ( Using Advice on this site) POPLA rejected .
ECP submitted photos of signage for 'Pay by Phone' but these sign were not in place at the time, otherwise I would have used them !!
POPLA route seems waste of time - Now await threatening letters but am fully prepared to go to court on this one , as their photos are contradictory and did not reflect what was there on the day .
    on the day .
There were also plenty of people on the day who could not pay .
Also not been able to track them down !

    Hi Tony,

Sorry to hear your appeal got rejected, but glad to hear you're not giving in.  I'm just at the stage where I am reviewing ECP's evidence/response to my POPLA appeal before giving my final 2000 word response.  I'm hoping to get a good look at it tomorrow evening but I'm not holding out much hope after hearing about your experience.

However, I'm also prepared to go to court with this and the above comment from Umkomaas is very reassuring.  I'll update this thread as I go, and hopefully more people who've fallen foul of these cnuts will find this  as well.
