ECP DCB Legal court claim


I've received a ticket for parking in the Euro Car Parks carpark at Greengate Manchester in August 2020. The machines were not working and I remember there being plenty of people in the same situation and am looking to link up with any of them. PM me or reply to this thread if you also got a ticket on or around that day.

I just got a NTK. I had taken some photos of the machine not working (it would not connect to the network) but now I can't find the photos. There were at least five other people standing with me doing the same thing, not to mention how many others before and after, so I was hoping we could pool evidence. I was just starting to write the template appeal letter when I realised I couldn't find my photos.
It's s long-shot, but I thought it was worth trying...0 -

From your previous parking incidents you will have learnt to send the blue text, one size fits all template appeal easily found in the NEWBIES thread.
Send it unchanged - no additions or alterations needed.

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,
Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Out of interest, does anyone know how possible it is for them to falsify the data from their ticket machines? I would like to think that they can only show that no one was able to pay all day, or longer, and therefore be tripped up by their own machinery.2 -

Someone who experienced the same parking incident as yourself may come onto the site and it is useful to pool resources. You will though have to start the process irrespective of whether anyone else has experienced the same issue.
The PPC's will have to prove that the machines were working. The onus is on the Claimant.

Thank you. I did start the process a few days ago and am looking forward to their response. Because there were clearly many people in front and behind me at that car park I am hoping that some of them find their way here and see this. I'm actively spreading the word about this forum wherever I can.3 -
So Euro Car Parks rejected my appeal and I am about to submit my POPLA appeal, but at the very start of the appeal (Step 1) I am unsure which options to select. There is no advice about this bit on the Newbies thread.
Can anyone advise me here?0
