You have to decide how you want to handle this and not confuse your options. You can either try to push for a full refund due to it being a distance sale and therefore you must insist that your handling does not contravene Section 34, paragraphs 9 and 13 of the Consumer Contracts Regulations 2013 (CCRs), ie, you handling has not gone " beyond what is necessary to establish the nature, characteristics and functioning of the goods if, in particular, it goes beyond the sort of handling that might reasonably be allowed in a shop". Failing that you can instead attempt to get a refund under the terms of the Consumer Rights Act if the PC is in fact faulty.
Forget the question as to whether it's a gaming PC or not, Scan 3XS specifically market this as a gaming PC, a poor entry level machine but a gaming one nonetheless so you won't get anywhere trying to insist it isn't as described.0 -

Honestly I'm not optimistic for you. "Gaming PC" is subjective enough that I think you're on a hiding to nothing there.As far as faults go, it's hard to say if the fan noise can really be considered a fault. Same for slowness.And for cancelling it in accord with online selling rights, I think AO can say that you've used it enough for that to no longer apply.If you get nowhere with AO, then contact Scan (the manufacturer).0

Fair warning, they are unlikely to find a fault with it. The fan noise is normal for a Zen chip using the stock cooler. They boost themselves up regularly even during idle, unless set to not do so. This increases thermals and the fans will boost their speed to cope. It took me by surprise for a while when I built my 3600 machine. Regards the sluggishness of the machine, it'll be something daft like ram not set to proper speed via xmp in bios or just having 8gb of ram (16 is pretty much the standard now).0

Your understanding of the law is rather flawed ... under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 the OP can indeed return the goods for a refund. The seller can equally reduce the amount of refund to account for the consumer's handling of the goods over and above what they would be able to do in a shop.
