My old 5 year old PC isnt any where near as loud nor does it freeze nor did it when it was first used. Researching the fan noise suggests it could be coil whine.
One thing with modern PCs - especially gaming ones is that with a decent GFX card onboard and a decent processor, they will get quite hot quite quickly and depending on the cooling may well be louder than a 5 year old box.
A lot of course will depend on the components/case/cooling
Coil whine as Spank says, is probably the PSU.
Agree, that the freezing may be an issue - if it was a one off, i wouldn't be too concerned (not saying there isn't a problem though)
Looking at the speccs though - I wouldn't expect them to have spent a great deal of time or money on the components.
    Hope you get it sorted/refunded
  • Oh and the PSU was put in upside down. I know this is not a bad thing but it must have been an omen of things.
  • Spoke AO again. They wont accept my rights to return it in 14 because I've identified a fault with it. Now I have to speak to the manufacturers. I said its not a gaming pc as described but I still need to speak to the manufacturers about that as well.
Never buying anything with AO again.

Your rights are against the vendor don't be led astray .
  • It's my birthday today of all days and I have to deal with this. They just kept saying they need to identify a fault first and confirm that it's not a gaming PC.

Well it is a gaming PC, just not a very good one and aimed as purely an entry-level system. You're only hope for a full refund is that they find an actual fault with the system.

Unless they are claiming it is tailor made which I don't think it is surely you have every right to return it without a reason being needed.

Apparently, because I've said there is a problem with it, I cant do that.

Rights are either to reject the goods for a full refund within 30 days but the presumption the goods did not confirm to the contract at the point of sale doesn't exist so they can insist you demonstrate this.

Following this option if the manufacture confirms a fault then you can refuse anything further from them and go back to AO for a full refund with your evidence of a problem.

Other avenue is a repair, replacement or full refund (retailers choice) and with this the goods would be deemed to not have conformed unless the retailer demonstrates otherwise, a lot of these companies pass you on to the manufacture, on the one hand it is the retailers obligation to resolve but on the other hand if you didn't get a resolve and had to go to small claims you do have to mitigate your losses and the retailer could argue you haven't by refusing to let their third party assist (whether that would be a valid argument I don't know).

They are saying he's been using it more than was necessary and therefore wont accept the return for a full refund under distance selling rules. They can't, stop the return but they can deduct an amount to take into account the diminished value if he wants to go down that route.
