Parking Charge Notice - Do I have grounds to appeal or not? Please help.

    You lknow the response
    ITll be rejected
    Then you appeal to POPLA under the HIRER grounds, and either PE concede or you win. 

    You knew it was going to be rejected.

    Re-read that last sentence of nosferatu1001's post.
    Particularly the bit that where he says "either PE concede or you win".
    Which bit of that do you have trouble with?

    A hirer has no liability if they failed POFA

    So did they fail POFA ? Timing , wording and hire docs should be checked

    Normally they all fail on not including the hire docs , meaning a slam dunk win at Popla

    No hire docs were provided at all and the letter was issued almost 3 months after the alleged event. All they sent to the hirer was the parking charge notice?

    I would look at any successful popla appeal where a hire or lease vehicle was involved in the last 12 months and plagiarise it

    Thank you :). Looks like I have a ‘golden ticket’ following what I have read on that thread as there is a large section missing on the back where they have failed to include the POFA details?

    They failed to include because they know they havent met POFA to hold a HIRER liable. 
    No need to question. You KNOW this.

    Thank you all for your help, it is much appreciated :). I have now submitted my appeal to POPLA as HIRER using the golden ticket template highlighting the fact that they have failed to meet POFA, including a photo also of the missing paragraph on the back of the PCN and sent the parking charge notice almost 3 months late to the hirer. I will keep you updated on the appeal progress.
