My assignments with the FOS have been very varied.
The first case took 3 weeks to be assigned and I've heard nothing yet. The second case got assigned within 2 days to a principal ombudsman and he said I should hear something within 2 weeks and my 3rd case got assigned within a week although she has decided to give Payday UK another 2 weeks for a final response, so who knows how they are allocated. I get the feeling the way you possibly worded the complaint did not show the unaffordability aspect.
all my loans and complaints are based around the credit procedures being performed at the point of applying and weather in reality I should of been allowed to roll over multiple loans repeatedly.
(lots of late payments and defaults on my credit report) i've spent quite a bit of time complaining about this and have had success in getting them removed.
I used the template from the Debt Camel website.
They still refuse to tell me how much the loan is actually for and I have no access to the bank account it was paid into. It was rolled over four times.
The adjudicator said that there was no requirement for payday loan companies to credit check and so the 12 defaults on my file should have no bearing on the matter and they haven't loaned irresponsibly because I should have been honest about my outgoings! Also because of the fact I didn't tell them the minute I knew I was ill (Sara from Debt Camel was not happy about this- she said they clearly have no grasp of mental health issues, I had a total mental breakdown and could barely speak to my GP let alone a payday loan company!!) this was apparantly unreasonable behaviour on my part!!*The RK and FF fan club* #Family*Don’t Be Bitter- Glitter!* #LotsOfLove ‘Darling you’re my blood, you have my heartbeat’ Dad 20.02.200 -
Just wanted to share some success with you guys.
At the start of March before I even wrote to various PDL, I spoke with the FOS to ask what to do. They took basic details and advised that I sent my complaint and contact them after 8 weeks if I wasn't satisfied. In all my letters of complaint, I said that I had already taken advice from the FOS and they were awaiting instruction on whether to act or not.
2 weeks after I had sent my complaint to Wonga, I called them to get an update. They said they would only speak to me via the FOS and they had sent what I needed to them.
I called the FOS and that was correct. Wonga had chosen to deal directly with FOS and within 2 weeks she has already sent over to Wonga her recommendation.
5 weeks later (so 7weeks from sending formal complaint), I have £3000 in my bank account - just 2 days after accepting the offer.
Apparently with Wonga the FOS are trying a new system as there is so many complaints! Certainly worked for me!
My other complaints are now waiting to be assigned to an adjudicator!

Does any one have a template of a letter I can use to attempt to reclaim charges from credit cards and catalogues?
I have tried to down load one from this site but it won't open as I only have access to the net via my mobile.

Seems like a bad decision to me. I would definitely escalate it to a final ombudsmen for their assessment. I have had 1 rejection from the adjudicator overturned by the ombudsmen, so its definitely worth a shot.
I would also recommend double checking your credit file, because I was initially told that WDA don't need to do a credit check, but a review of my credit file showed that they had done a full credit check anyway. Therefore they will have had knowledge of my negative credit history and chosen to ignore it for their own gains. This was very powerful in getting WDA to finally accept the adjudicators decision.
I used Checkmyfile.com to get my credit report, as it pulls data from all of the major credit agencies. If WDA have done a credit search in the last 24 months it will appear on your report. Checkmyfile.com charges a monthly fee, but you will be able to get a free trail - just remember to cancel it before the trial period.

Thanks ginger- unfortunately these loans were from 2013 so any credit searches will have long gone. WDA wrote to me today, requesting payment. I sent their income and expenditure form back showing my current situation (dire) and copies of letters from my consultants along with a letter re-iterating the loan won't be repaid any time soon. I got a survey from the Ombudsman today asking how the adjudicator in this case had done and I was utterly scathing about her!! You should escalate it with them. I think you have a case still. Can you get a copy of your report how many defaults and Kate payments did you have before they lent you. ??0

Finally got through to cash genie and they've said I should hear back regarding my complaint by the end of the week, they've also sent me a statement of account but all of the information is wrong, shows I borrowed less and paid a lot less interest than what I actually did pay. Through my bank statement shows I paid nearly £600 in interest but they are saying I paid around £200.
Could it be a mistake or do you reckon they've done this on purpose??0 -
My complaint against QQ and p2p has been upheld by the adjudicator.
Is it likely QQ will argue? He has been pretty through with everything including referring to my credit file several time and defaults etc0
