  • Did any of your complaints go to FOS stage and if so did you tell the FOS that this was due to a gambling issue or is it best not mentioned?

    Yes, I informed the FOS of this as I had also included it in my initial complaint to the lenders.


    In my opinion affordability checklists and income/ expenditure forms do not take into account the actions of people who are vulnerable through addictions or mental illness and that is why it is so important for the lenders to have robust lending decision making processes. Any sort of credit file review would show that the credit history and the amounts entered on the income/expenditure forms didn't tally up. And this is where the irresponsible lending really is hard to argue against.


    If you get a copy of you credit report it will show if any of the lenders completed a credit check prior to awarding the loan (for loans within the last 24 months). If they did and there are clear indicators of financial difficulty on your report, then they have clearly acted irresponsibly and lent money despite having all the evidence they need to identify someone with an addiction or underlying financial issue.


    I have not used debtcamel or any other templates, so I am definitely not saying you should do it my way. But I do think you should make your complaint personal to you, particularly if you feel there are enough indicators on your credit file which you can use against them.
  • The only one of my complaints that the FOS has been in contact with me about so far is against Wage day advance. The lady at the FOS is extremely friendly and after reviewing my credit file provided me an initial opinion that WDA should have been aware of my financial difficulties and recommended that they refund all fees/ interest plus 8% and remove all references from my credit file.


    WDA rejected the FOS initial opinion stating that they were not obliged to run a credit report, and the only credit check they do is 'call credit' which confirms identity and employment details. The FOS went back to them informing them that according to my credit report they had run a full credit check and therefore they should have seen the position I was in. WDA once again rejected the FOS opinion stating that even if they ran a full credit report they do not need to use it.


    They are really digging their heals into the ground with this one. I think they must know that if this one goes against them the floodgates will open.


    I would love to see this company go bust. I don't like to hear of people being made redundant but the whole WDA company is a total disgrace. The complaint handler (Andrew) is a heartless immoral arrogant scumbag.


    The FOS complaint handler definitely seems to be on my side with this one, so hopefully I'll hear her final decision this week and I'll let you know how it goes.
  • I've fired off an email to vivus asking for my loans/payment info as i can't find it on my credit report... Then I can start my complaint.

    Sent a chaser to Wonga, no response. Is it worth giving them a call? I just feel like they're not even actioning it.

    Had a letter from PDUK today. I requested account statements sunday. They are asking for proof of ID and utility bill and £10 to process a formal subject access request lol. Is this stalling tactics? I never made a subject access request

    Maybe they are introducing these new stalling tactics as more people are starting to complain.

    I asked PDUK for statements on 06/02 and received in the post 10/02 - no issues.

    I can confirm that before the loan was entered into, we undertook credit checks with credit reference agencies. From these checks we obtained details about your credit commitments and the details you provided to us relating to your income allowed us to determine that you were suitable to enter into the loan.

  • If there is proof that the loans were unaffordable then there is no harm trying. See debtcamel and copy 2nd stage template

    Boatdweller, if you think any loans were borrowed to you and you could not afford them, then I think you should complain. I think a lot of unaffordable loan complaints will not go ahead because people think the amounts are too small. Just keep going we will get to the end game one day.:cool:
