    Thanks to this thread I have contacted 5 companies, however is there anything I can do regarding Payday UK's refusal to provide a loan history?

Therefore, we have no current obligation to provide a statement of account under Section 77 of the Consumer Credit Act as per Subsection (3) of Section 77 which states that the requirement under “Subsection (1) does not apply to – (a) an agreement under which no sum is, or will or may become payable by the debtor.”

    Wonga offered me a few hundred pounds. When I went to the ombudsman it increased a little and the Adjudicator asked if i wanted to accept before they even looked at the case. I declined. They came back with another offer but on 5 years worth and not the 6 i complained about. I rejected on these ground and then had to wait for an Ombudsman, who eventually upheld my complaint.

    As for the smaller amounts, there were only 3-6 loans but still managed to reclaim :-)

  • Payday UK's standard response is to refuse to provide info, so just put your complaint in straightaway. They normally respond within the 8 weeks, then go straight to the Ombudsman if they decline your claim.

    Sooooo.....

    This has been a pretty long winded process. I complained to QQ and Wonga back at the start of June 2016!!

    i had loans with both companies from 2008 until 2012 and then again for a period in 2015. Both Wonga and QQ refused my initial complaints after dragging out their responses for months, well over the 8 weeks.

    Both were referred to the FOS in November 2016. Both companies then delayed and refused to consider both complaints because both had loans that were well over 6 years old.
    I got fed up of the delay because there was no end in sight and appeared to be at a stale mate because of the loans over 6 years old.

    I asked the FOS to just look at the loans dated 6 years previously to June 2016, so from June 2010 onwards just to settled the complaints. They did this, today I have received by adjudicators decision re the Wonga loans, still waiting for QQ but don't think this will be long now as they have all the information and is with an adjudicator.

    Wonga will be refunding interest and charges which is over £1000 and removing info from my credit file.

    I am very happy with this as i settled my DMP earlier this year and have been saving for a deposit on my first home, so this will be added to this and i am nearly there.

    Fingers crossed for a positive outcome from QQ too.

    Okay, long time reader but have posted very much. This is an interesting thread. I have started these proceedings after reading all of your comments and passing on your knowledge. Well done to the Ines who've won too! Good job!
    My question however is my mother used some of these shops with a cheque and guarantee card and rolled over writing new cheques every week for a long time (she was doing it for me I'm sad to say)
    Am I able to start proceedings for these even though a cheque was written...they were never cashed as another was written the week after to cover the first. She didn't work either and had them over 3 shops...do I have a case here?
  • How do i go about with this? Quick quick declined this via resolver and FO didn't do anything either.

    No, it does not apply to cheque cashing services, only payday loans.

    Most likely these transactions took place more than 6 years ago anyway, so would be subject to the limitations act.

    Can you elaborate on your story a little more please, more detail would be good, how much did you owe, over how many loans, what was the reason given for declining your complaint ?

    They are correct, under the CCA sec 77/79 they dont have to provide a statement, as no sums are owing.

    Just bang your complaint in anyway, estimate the sums involved, they will correct you, if necessary, in there response.
