    Do you know if it is illegal for a a creditor to remove a default i was of the belief that it was at their discretion?

    It's not illegal, it is at the creditors discretion yes.

  • A quick question to all who have used Mr Lender may i ask how soon they were able to respond to resolve you claim?

    Mr lender was my smallest claim it took 5 days from my original email for them to make me an offer accepted it that day and received the money today. in total from my complaint to receiving my money was 1 week total however this was only a small one claiming £54 back

    Hi. How long did it take for people to be allocated an adjudicator? Mines been over a month, is this normal?

  • Ok, slightly confusing situation. My complaint with Wonga is with the FOS and i have an adjudicator assigned. Today i received and email from the FOS stating that WONGA are offering £1036.10 for loans 30,31,and 32 as they deemed them to be unaffordable - on what criteria, I have no idea! This would be in full and final settlement.

    My adjudicator writes to say that they are unable to recommend the offer as they have not looked at my case yet.

    What should I do? Why have they only commented on loans 30, 31 and 32? I should add that the first 27 are over 6 years and Wonga are saying it is outside there jurisdiction...?? Has anyone had any success with complaints over 6 years old?

    Your views and comments would be really welcome - i have until the 18th to respond.

  • welliesrgreat I am in the same predicament except my offer is much lower. I will read any replies with interest.
  • Finally received a provisional response from the Ombudsman.
    Back in early September my adjudicator felt that 11 out of my 18 loans should be refunded. Lending Stream disagreed and my case was allocated to an Ombudsman. The case has been delayed due to loans being over 6 years old. So today I received the provisional response and the Ombudsman has upheld my complaint and has suggested a refund of 17 out of 18 loans! I am so pleased and hope this doesn't change in the final response. This figure is likely to be around £7000.
    As you will see in my previous posts I have been very successful with refunds, I just cannot believe that I sustained paying these amounts for a period of 5-7 years.
    Anyone seeking a refund must be prepared for a long wait.....but it might just be worth it! I started my complaints in June.
    I think my payday uk case will carry on for many more months as this includes lend from 2008.
