  • Hi, sorry to be a pain but this tread is far to long for me to go back and read it all, but i could really do with some help. i'll explain my situation and any advice would be very much appreciated.

    today i got a text message from a company saying reclaim payday loan and a link.

    i had loans out with Wonga, payday uk and Quick Quid.

    I filled in the online application and they said they are going to get back to me.

    In total I borrowed 12,265 from the companies, and eventually ended up default with from wonga, with £200 left to pay. However months i received an email from wonga saying they will remove the default , then a few months later of my wonga history had been removed from credit report. Then about a month later all of my quick quid history was removed from my credit file, how ever i still have all the emails as evidence.

    So the company that contacted me, should i go with them , or is there is another way to make a claim,

    Hi, as i understand it, you can go directly to the companies in question based on unfair lending/ affordability etc.
    Search Debt Camel and there is step by step guide to beginning your compliant direct with the company or taking it up with the FOS.
    It takes it's time but people seem to be getting results under the right circumstances.

    Hi Ali,

    As with all these things it's a personal choice but a claims company will take possibly up to 30% of anything you get back.

    As said above get onto Debtcamel and there's good advice on how to proceed.

    It's not too difficult to do it yourself and no claims company can get it done any quicker than you on your own. There's actually a strong argument in the case of PDL complaints that only you know the history and can make a far better case than any claims management company could.

    It does take time though so patience is a virtue.

  • Ok so 8 weeks since initial complaint email to Wonga. In short they have rejected by complaint. Firstly on the grounds that some of the loans were taken out over 6 years ago; is this correct practice?

    "Our records show that you also took loans between November 2007 and July 2010 which means they were sold more than six years before the complaint date. We do not consider it appropriate to investigate the complaint about these loans. Furthermore, as this complaint relates to loans being unaffordable, we think it should have been clear that the loans sold more than six years ago were unaffordable by the time they were closed."

    Secondly the loans after 2010 were considered by Wonga to be affordable.

    Is it standard practice to reject most complaints? Is there anything I can do to respond to provoke them? Or, do I just need to go straight to F.O?

    You do not need a 3rd party claims management company in order to get your payday loan interest and charges refunded.

    They have a step by step guide to making your complaints yourself, and for the cost of a stamp.

    A claims management company will have no more or less success, than you will yourself, and they will take 30% at least, of anything you get back, you will just be throwing away good money, so do it yourself for free.

    Quick question regarding Wonga. I have heard back from Wonga and I am going to accept their offer but not sure how long it is going to take to get the money paid into my account. Any ideas?

  • Some good news to report. Recieved a letter from the adjudicator upholding my complaint against Different Money Ltd.

    I took out three loans with them in total. The adjudicator determined that the first two were affordable but the third was not. He's therefore requested the PDL to refund any interest paid on the third loan and wipe it from my credit file. I estimate the refund to be in the region of £200-£300

    Very pleased with the result. Different Money have been given the chance to reply before it's final, but fingers crossed this is the end of it.

    Any money I am refunded will go straight to paying off any outstanding debt so it would be a big step forward.

    You should always make your claim to the original lender, even if an account has been sold on, the OL added the charges/interest etc, so any complaints regarding refunds must be made to them (FOS Policy), and they must investigate it for you, they cannot use the fact they have sold the debt, as an excuse not to.

  • I am happy for you. Well, I have learned that no one should ever get a loan from a payday company. Do whatever you can not to ask for a loan from this kind of sharks. Even if you can't pay your rent or electrity bill or whatever...never ever borrow money from them.

  • Does anyone know roughly how long it takes for an ombudsman to pick up the case once the adjudicator refers the case to them?

    I'm expecting a lengthy wait, but would be good to know if anyone has a recent experience of this part :)
