Yes it is a new development. It seems that Judge is finding a way to get round being held to be draconian, if he/she strikes out parking claims.

New poster here, but I have read everything here carefully, and been following your guidance, but I have 2 questions:
Quick background: We have received our first letter from CST Law (with the usual “We have been instructed by Debt Recovery Plus” language that earlier posts explain is not valid). [Context is Fistral Beach => Initial Parking => DRP letters => now CST].
I’ve seen your earlier debates on whether to (a) ignore CST totally, vs (b) reply to CST denying any liability and asking them to stop any further contact.
But I’m interested in how to help stop these cowboys doing this to others… (esp watching my wife get really upset about the letters and want to pay the scammers to make it all go away)
Q1. Would it be worth complaining to the SRA about Jacqueline McGuirk, a Director of CST and a Solicitor?
Presumably the more complaints the SRA get, the more likely they will be to investigate?
(eg Telling CST “Please inform your Director Jacqueline Ann McGuirk (SRA ID: 139812) that, by sending out letters such as this, where you purport to have been instructed by a company with whom I have no contract, I believe that she, and the company of which she is a Director, are in breach of Principles 2, 3 and 4 of the Solicitors Regulation Authority, and I am duly complaining to the SRA about her behaviour.”)
Q2. Is there a thread on ANPR cameras, and entry/exit time vs time paid for?
The crux of my case is that we paid for the time we were parked (5 hours), whereas they are claiming for the time between entry and exit (which was substantially longer, as it was a busy August weekend at Fistral Beach, and took ages to find a space etc).
I’ve read the “Waiting for a space is not Parking” judgement, but, in that case, the driver did not actually park, so there was no contract. We did park, so can’t rely on that judgement? I believe the question is when the contract was formed and what the contract was (ie to pay for time parked, or for time in between entry and exit.)
Is there a thread on ANPR timings vs parking timings?

Let's talk CST. We actually thought that CST had given up this utter rubbish of saying they have been instructed by DRP ....... CST will not and cannot answer your questions. That's perfect for a judge ..... and talking about judges, hope you have seen this thread by @lockable posted today who has shown a court order regarding CST. The judge has asked CST questions which again they will not be able to answer, certainly not as they signed a statement of truth ?

It seems that Jacqueline McGuirk needs to sort out her business model and stop fabrications that has now led to a judge asking the very same questions that we ask.
Of course you can complain to the SRA, firms like CST should be sanctioned or removed from the SRA

Unpaid debt reminder notice and an LBC both dated same day and requesting payment to DRP (nope).
SAR on its way to UKCPS and denial of debt to CST.
For anybody in the same boat, the email for UKCPS is dataprotectionofficer@ukcps.net
They don't seem to like advertising it on their website, I had it from an earlier case when I won against them with the IAS
