    Your P45?
Don't get greedy. It's really not worth it for the sake of 2 weeks money. Dishonesty is not a good trait in an employee.

Pedant alert - it's could have, not could of.

So they came back to me and said I'm still employed but I'm not on gardening leave etc. And they can ask me to use my holidays. What is stopping me starting my new job on monday and not telling my old company? That way I will get paid until end of july off both?? Or am I missing something
It will probably be a breach of your contract of employment, and they may then dismiss you and not pay your notice. You would also have to explain to your new employer why you can't give them a P45 and have to tick statement C rather than B on the new starter checklist. It may well be in breach of the contract of employment with them.

It really isn't worthwhile to double up your wages for a few days. Ask your ex employer for permission in writing to start your new job immediately if you are that determined, but they may well refuse.

Got to say the person this thread is about certainly sounds like their current companies better off with him/her with their attitude.

You cannot work for new employer whilst you are still employed by your current employer unless they give you permission, they can also have you take your remaining holidays.  I hope your new role works out, you will be on probation (likely one weeks notice) so you better get selling, be careful though, check your contract for any non compete clauses, If I were your current employer I would take legal action to enforce this in a heart beat.

You previously said you handed your 4-weeks notice on the 1st July and that out of the 4 weeks notice they are requiring you to take the 2 weeks annual leave remaining.
You also said that you were starting the new job after the notice period ended, so I assume that means you already agreed a date with the new employer.  Something like the 1st August.
So, what is stopping you just starting at the new job on Monday?  Apart from it not complying with your contract of employment for the old job, is that you have already agreed a start date with the new employer and they will not expect you to just turn up two weeks early.

If you are not on gardening leave what are you on? except for the holiday days are you still expected to go into work?
  • I have just handed my notice in at work as I have confirmed a new job with a new company. My current employer has excepted by resignation but has said they have decided to put me on furlough during my notice period instead of letting me work my notice of giving me garden leave.

This means I will not get full pay and will only get 80%. is this legal? can they do this just because i handed my notice in?

    Thanks

They can put you on furlough, but the rate of pay depends, in particular, on whether your contractual notice exceeds the statutory notice by more than a week. See https://www.employmentcasesupdate.co.uk/site.aspx?i=ed40723
