Two Parking Charge Notices

I’d appreciate some guidance on the following, I’m sorry it’s a little complicated….

A driver of my partner's vehicle parked twice in the same car park and received 2 separate parking charge notices.  The driver did not buy a ticket on either occasion.  I feel there are mitigating circumstances.

On the first occasion the driver was asked by a member of the public to help find a missing person.  Subsequently police were called and shut access to the car park.  In the situation no ticket was purchased nor could the driver leave until the car park was re-opened sometime later.  The driver then returned some days later to the same car park following sad news received about the missing person.  Again, no ticket was purchased.

To add to the emotion of this period, my partner and parent of the driver had been admitted into hospital with a brain haemorrhage the previous week.

And, just to add complication.

The NTK was sent to my hospitalised partner who clearly did not receive the letters.  I eventually opened one NTK (which related the second instance), not realising there was a another….

What action did I take?

Having spoken to the driver I appealed on behalf of my partner to the second NTK using standard template wording citing £100 penalty for a £2 charge was unreasonable and asking the issuer to not contact my partner who was still very poorly.

My partner then received a Demand for Payment relating to the first NTK which I initially assumed related to the NTK I had appealed against.  I assumed the demand for payment and my appeal had “crossed” so decided not to react to it.

Some days later I realised there were in fact 2 NTKs.  At this point I decided to appeal to the first NTK received on the grounds of mitigating circumstances (the missing person police incident) but the appeal window had closed.

The good news is my partner continues to recover from the haemorrhage  but we could do without the 2 penalty notices and whatever action may arise.

Any advice appreciated.

    Not penalty - unless this is a railway car park?
    Why did the car return? To mourn? How long did the car remain on the second visit?

    Apologies, parking not penalty.
    It was a distressing event, so yes to reflect on what happened.  Second visit was less than 30 mins.

    Which PPC is it and do you have a POPLA code for the one appealed in your partner's name?

    PPC is MBW.  I appealed on their website, which submitted successfully and a code flashed up for a short period. The screen updated so I did not have time to write down the code.  Would this have been the POPLA code?

    No, you only get a POPLA code in a rejection letter from a BPA member.

    Yes, Minster Baywatch.  Based on your clarification I have not received a POPLA code (relating to the second PCN) - as of yet.

    Minster Baywatch (MB) is a BPA member and so you should receive a POPLA code.

    Ok thanks.  I will wait for the popla code for the PCN I appealed but what should I do if anything about the one I have not been able to appeal via MB website - should I appeal in writing?

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up,

    Just as the clampers were finally closed down, so hopefully will many DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
