  • Apologies ... I meant was the agent's communication to VCS included in VCS' SAR response? If not then you should report VCS to ICO. :)

    Ive just been on ICO website and it says I must complain to VCS first so just sent them an email asking for ANPR capture times for in/out, corespondence with my MP, and also the managing agent since they neglected to send it last time.

    Ive just seen a comment Jon Sandhu made to the IPC in the earlier SAR which reads "the motorist is clearly trying to use false claims to avoid paying a correctly recorded contravention and the subsequent PCN issued to them". 
    This comment was made in regard to my comments about the equality act.
    They then go on to say they have made reasonable adjustments due to the disabled bays and the signs were clear and "easily readable when a motorist drives onto site".
    My video proves otherwise though, you can hardly see any yellow disabled marking as theyre so faided, do they actually believe what they are saying themselves?
    They also say the sign would have been easy to read by someone in a wheelchair!!!!!!
    The sign must be 8ft up from the ground.

    How is this for paragraph 3?

    "3.  It is denied that any contract with the claimant was formed. A contract requires three elements, Offer, Consideration and acceptance. It is denied that sufficient time was given to complete these requirements.  The vehicle entered the car park, parked and was alighted at 15:13, the claimants employee ticketed my vehicle some 83 seconds later.                                                                                                                  Upon entering the car park I was aware of a sign but this was impossible and unsafe to read whilst moving, so having alighted the vehicle I walked towards the sign to read it, the employee waited for my back to be turned before ticketing my vehicle.                                                                                                                                                    This is in violation of the claimants code of practise which at the material time read   “15.1 Drivers should be allowed a sufficient amount of time to park and read any signs so they may make an informed decision as to whether or not to remain on the site.”                                                                                                                                          Whilst no specific time is stated, it is widely accepted that 10 minutes is the normally allowed time,

    It can be observed that at the material time the sun was low in the sky making visibility poor. The claimant will suggest that I parked near a sign, but since visibility was poor and I reversed into the parking bay the sign was not visible. I am unsure how any disabled person is expected to find signage, read it, understand it, then make an informed decision as to whether they want to comply the terms or not and leave the site, all within less than a minute and a half."
