nosferatu1001 yes I know its not your process and I should do things myself, I am normally quite pro-active but with everything thats going on my head is spinning a little.
KeithP Yes I will follow what you have said, I now have a government gateway account which took me to the money claim, was going to it all monday when Ive got back from the hospital and my mind is a little clearer.
Le_Kirk Think Im getting a little bogged down with it, Ive registered an account with moneyclaimonline using my email address and set it up that way, didnt use the password on the letter. Ill have another look at what Im doing and try and sort it out. I interpreted some comments as meaning when I sign up to moneyclaim they post me some log in details and went into a flap.
Its now asking me for 'claim number' and 'defence pack password'

Sorry if Im becoming slow, Ill get it.

Just had an email from FHP saying "I have raised a formal request to cancel the ticket on behalf of the landlord for you with the old operator, but do not know what their response will be yet as my old contact is away until the 8th, and of course they no longer have a contractual interest to protect with our client.

I will let you know when I get a response from them."

    it will ask for payment?
But you are not paying ellaro9, aren't you exempt?

You need to apply for help with court fees (online) and get a reference for your application and you put that in the covering email.

    Hi CM
It turns out I’ll have to pay.
I qualify on some of the criteria but have too much in savings, had to sell the car because I couldn’t drive it and the money went in the bank.
Its not a problem, I’ll pay the £60 with a smile, the car money will pay for it.
Will double check on Monday when I call them though.

Ah, OK, well worth £60 and your counterclaim includes asking the court to order your fees paid back.

If they discontinue their claim you will also have to pay the hearing fee instead of them, to bring it to the Judge (£80 I think, for £900 in play).  Again, the other side pay it if and when you win your case.

I can honestly say I would rather burn £185 than pay them, truly I would, so the £80 would be money well spent.
Thought if there was a counterclaim they couldn’t discontinue.
The principle emailed me to say they asked VCS to cancel, I have the email and will show the judge.
Rest assured that if we do win, I will be donating £185 to charity out of the £900

You also might have to prompt your local court if that comes to pass. They sometimes forget about counterclaims.

What a difference a night makes, have just been going through the last few posts and can see where I was beginning to lose it, feel much better and clearer after a nights sleep.

I certainly will be prompting them if necessary.
The judge that heard my friends cases seemes very clued up about PPCs, each hearing was around 5 minutes, I think he had already made his mind up before we even went in.

More prompt them to ask you to pay fir the hearing, and not just vacate it.

Ifr they drop a claim following  a counter claim,  what does that say about the merits of their claim.
