    You can certainly put that into your defence with counter claim added in , decide on the claim amount because your fee will vary accordingly

    But you must get on with acknowledging the claim online , not earlier than 5 days after the issue date on the claim form

    Post the issue date below , plus the name of the claimant parking company , plus the total amount claimed by the parking company

    email a SAR to the DPO at the PPC and attach a copy of the claim form as proof of I D under the GDPR law to obtain all your data

    now sent me a claim form so its just got real

    Assume you mean from VCS. From what we have seen of late, not the smartest page in the book

    But, you now follow the experience on here to the letter.
    Remember, you can transfer to your local court

    NOTHING is going to happen before xmas and well into the new year.  A good defence will zap them anyway.  Like all the parking firms, desperation for money is the key and that alone means they take daft claims to court as we see from VCS of late.

    Hope your surgery goes well and part from making sure you do what the regulars say, you can relax

    The date on the form is 1st December 2020, so I dont acknowlege it now, leave it until the 6th?
    The company is Vehicle Control Services, interestingly the name of the claimant is 'Jake Burgess', thats who I sent Coupons letter to.
    I have already sent for a SAR, they ignored the first one but sent it on the second request, they sent me a copy of the letters we've exchanged and a copy of my blue badge, do I need to do another one?
    £185 plus interest which is unspecifies.
    Theres a comment within the SAR that my video doesnt show me entering the car park so doesnt show how long I was actually in there for before leaving my car. I still have the entire video which show me enter, park and immediatly get out of the vehicle. I think the total time in the car park was 6 minutes.

    Just had a reply from FHP which says  "Hi ellaro9,
    I made some enquiries on this for you and requested details of the appeal rejection, but unfortunately never received the information, and since that point they are no longer instructed on this site as the client has moved to another operator so they are no longer responding to me.
    Have you had further correspondence on this?"

    It sounds like they dont have the contract with VCS after all.

    Thank you kindly, it means a lot.
    Ive got to have 2 surgeries, the second one is spinal but they cant do that until Ive had my first surgery which is for something else.
    I will follow all and any advice to the letter, and really appreciate everyones time who comments to offer advice.

    Wont have long to do a defence since Im going to be in hospital and convalesing.

    Are you sure his name appears on the Claim form as 'Claimant'?  I don't think so, I think he's merely the name at the bottom who filed it.

    I reckon you should, yes.

    For just £60 in court fees (or free if you qualify for 'heolp with court fees' - Google, check and apply!) you can claim £900 for Equality Act breach and DPA breach and harassment under the PFHA.  Somewhere on here I posted a draft counterclaim for someone recently... £900 is a good sum because it sits at the bottom rung of the Vento guidelines for harassment of disabled people and yet isn't so high that a small claim Judge might be put off awarding it.

    Hopefully KeithP will be along with exact details but Sunday or Monday is probably best for the AOS

    If the SAR has been done , no need for another one unless chasing new data only , not data already received

    Decide on how much you are counter claiming for , then start on your Defence + counterclaim draft , that is the most important task for now

    Jake Burgess works on the legal team at VCS (and Excel) , so nothing interesting there

    I meant Jake Burgess has signed it, VCS are named as the claimant, I thought Simon Renshaw Smiths name was usually at the bottom, thought it was strange since I posted Coupons letter directly to him so he is aware of this.

    Not sure where my old blue badge is now, Ive got a new one since then, but they have sent me the picture in the SAR of it that I initially sent them. Wont bother with another SAR then as this ones dated 2nd July 2020.
    I do most certainly wish to counter claim against them, theyre disgusting and I feel very strongly about it.
    Looks like I will get help with court fees.
    RedX Ill submit my acknowledgement on Monday as youve advised.
    Looks like Ill need to do everything monday as Ill be in no state to do anything next Thursday onwards following my surgery.

    FHP have confirmed they tried to cancel with VCS but VCS were adamant that I should have to pay the 'penalty' as Id broken the terms and conditions.
    They have confirmed they instructed VCS at the material time.
    Are they included in the claim?
