WTC with disability element

I have been receiving WTC with disability element for over 10 years and I have just received this letter. Has anyone else received this type of letter? I am confused as I have never had any of the benefits mentioned that they are saying has recently stopped!
Thank you

If you've never received any of those benefits then what other benefit were you claiming previously?

  • The original claim for WTC was all completed and sent off by a person in the Job centre. I was receiving Incapacity Benefit.

So you may have qualified originally due to IB, and then your ongoing qualification would be via the WTC disability element itself (what is called Case G in technical terms). Have a look at this sheet: https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/831272/TC956_Disability_Helpsheet_Eng_2019.pdf Do you also meet condition 2 (you continue to have a disability that puts you at a disadvantage in getting job)? If you do, then you should continue to qualify.

  • Thank you for your reply Jess, I will check the link. Yes to Condition 2 as not able to work a full day/ week. Just seems strange to suddenly get this letter regarding benefits stopping that I have never had!

You might also want to look at information on Personal Independence payment to see if it is relevant to you https://www.citizensadvice.org.uk/benefits/sick-or-disabled-people-and-carers/pip/
Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

Hi Jasper!  Me too. Only they have stopped mine without telling me. I got my renewal notice yesterday and all seemed ok.  As I like to make sure they have the correct earnings for previous year I went to my online account and filled it in.  To my horror on checking future payments it had gone down by around £250 a month!  No mention of this on the renewal notice.  I then spent an hour trying to get through on phone but all they could tell me was the disability element had been stopped.  What? After donkey years they decide I don't qualify for that?  I'd claimed, just like you had.  I'm now waiting for a call back but I've put everything in letter to them too.  Good luck. It's so worrying when they do this without reason as far as I can see.

Kitten - did you qualify initially due to Incapacity Benefit/ESA as well? Have you ever received DLA or PIP?

Hi Jess!  Yes, going back many years, from memory I was on Incapacity Benefit. No DLA or PIP every claimed.  Went for medical assessment and found to be at disadvantage of getting work due to physical condition.  I then started working 16hrs per week.  I had a visit from what was then the DSS and was told I could claim Disabled Person's Tax Credit.  I'd been in receipt of council tax benefit with disability premium so my claim was accepted.  Around 2003...I think, it became Working Tax Credits, still worked 16hrs, no change to disability.  As to why it's been stopped I've no idea, still waiting for someone to ring me.
I've had no notification from them whatsoever that disability element has stopped.  Just purely by chance I went on line and saw my payments had changed to almost nothing!  Very stressful indeed.
I've not had a call back from them yet.  I've posted a detailed letter to them, sent Recorded Delivery.

Thank you. It is an issue that doesn't come up very often - odd to have two posts on it in a short space of time. I hope they get back to you.
