Has anyone tried the issue of proceedings in European Small Claims
I’ll certainly be up for this If there’s anyone with some legal advice?

i bought on my Halifax Clarity MasterCard and they are refusing to process a section 75 claim as they say “RyanAir’s refund policy states they are not obliged to issue refunds when a flight is cancelled due to exceptional circumstances”

I’m wondering, has their refund policy always said this or was it recently changed?
EC261/2004. This is not Ryanair's call to make. The law overrides any terms and conditions. Tell Halifax this.

Procedural question while this is waiting to be sorted out.
I'm in the same boat as most other people here, requested cash refund, RA acknowledged refund request, sent voucher etc.
I have not and don't intend to go through the extra steps RA have now prescribed to redefine my refund request, I have already requested a refund, it is RA that chose to ignore that.
Anyone else going down that route or do I need to get in the 'priority refund queue', as someone described it?
(As that person also mentioned, I'm surprised there isn't a fee!)

There is no priority refund queue.  If you want a cash refund you need to follow it up after receiving the voucher.  If you do nothing then Ryanair will deem you accept the voucher.  So you either follow up with Ryanair to get put on the refund list, or you take other action like Section 75 with a credit card, or court.

Hi All, Happy Monday! I have just tried to do a refund with RA for the 12th may they say Its not been cancelled? This was a return flight as booked with EJ to go on the 5th May - I have received that refund. So cannot use the flight. Do I have to wait until its cancelled? or am I trying to cancel it the wrong way? TIA
  • I did not buy a voucher. As the goods - a voucher - are not "fit for purpose" then it is Section 75 for me.

Just because easyJet have cancelled your outbound flight, it doesn't mean Ryanair must refund you for your inbound.  So as things stand, what they've said is correct.

That said, if and when they cancel it they will have to refund you.  But you'll need to wait for them to do that.

Has everybody been offered a voucher? I had my flight on 21st March cancelled and submitted a refund request on 20th March and have received numerous emails, last one on 9th April saying refund request is in queue, but have had nothing since and not been offered vouchers.

It's not so much the 'offer' of a voucher, I have the same timeline as you ie refund requested 20th March - there's been two emails since then, both saying refund in queue etc Third email I reveived was the 'here's your refund in the form of a voucher', it's not like they're emailing asking if you want one. Maybe check your spam just in case.

I know there isn't a priority refund queue, that was tongue in cheek.
But my basic question remains. I requested a refund, RA acknowledged the refund request, RA then supplied a voucher, I have not accepted the voucher, they just sent it to me, delivery is not the same as acceptance. I don't see that this text in the email that delivered the voucher absolves RA of the responsibility of providing the refund I requested 'If you do not wish to accept this voucher option and wish to move your flight or request a refund, please click here to contact us.' Just because that is what RA said doesn't mean they have a legal leg to stand on.

Try now - our flight for May 13th has just been cancelled but when I go on to get a refund and it says which passengers won't let me select either of the name so I can't get any further - a new Ryanair trick?
