    Even if you dont win the underlying claim, if you get eh claim set aside yuo can pay, in full, the CCJ and it goes from your record. 
    If you dont want to be pointed t othe single place which tells you everything you need, what exactly do you want?

    You need MORE than the N244 form. you need
    - draft order
    - witness statement supporting WHY you should get a set-aside
    - supporting documents such as council tax eg gap between parking and them issuing a claim, showing that they should have found your new address and served there as you could have been found
    - defense to the underlying charge. The template defense works just fine here.  all of this can be emailed? and to what address>?

    What was the date of the CCJ?  Normally you get 30 days to pay before it goes on your credit record.  To get to the DPO of civil enforcement use this e-mail address: -

    Paying a ccj over 30 days old means it stays on your record
    ask your local court for their email address.  Google may have the answer.

    Nope.  This will significantly damage your credit rating for 6 years if you just pay it off.  Don't.

    Re help with fees, yes you should qualify if on a low income, but Google 'help with court fees' for that application form and that goes in with your completed N244 and your witness statement and 'draft order'.

    Simply copy any other set aside thread.  See what others submitted and how they got theirs overturned. 

    The first thing to do is to ask the PPC, by email this week, if they will CONSENT to the set aside, given that (I assume?) the claim was not served to the right address for you and they made no attempt to trace your current address?).  A set aside 'with consent' is explained in the NEWBIES thread, and can be done 'on the paperwork' with a consent order, if the PPC are OK about it and they might draw one up (DO NOT ACCEPT BEING TOLD TO PAY THE PCN...nor anything that says they will 'mark the CCJ as satisfied' which is NOT what you want and leaves the damage there like an exploded bomb you then can't clear off your credit rating).

    People without any law experience do this successfully on this forum all the time.  I wrote the set aside advice in post #2 of the NEWBIES thread and have never studied law in my life.   

    It is a steep learning curve but it is mapped out for you here and people achieve this every week/month on this forum.  Just read any set aside threads and learn from others' success, and you can copy/adapt what they submitted.

    Do you have the whole claim form and the CLAIM NUMBER to set aside?

    For example,

    Seems to be an issue with set asides, notice a conversation by 2 legal bods on twitter. Go to google, search, goto bailiii.org search for cases have a read. Bang, you're more informed than most so people deem you an expert :D  (reminds me computers, if you can do a wee bit more than turn it on some folk call you an expert, meanwhile real techies think you don't know very much   )


    If you are willing to help yourself by doing some research, you'll usually reap the rewards. (that's a communal you rather than specifically you)

  • Hey Henrik, thank you so much for your info, I have checked that info that you suggested but I couldn't find anything specific when you say issues with set aside? do you mean I shouldn't complete this set-aside>??
     is it because of the lockdown?/ I mean I can learn anything I am very computer literate, but some people recommend things and point to a direction and not realizing that it is like trying to find a needle in a haystack, I don't mind a read but sometimes it's like enough information to get a law degree with..... but not actually getting the law degree. but if you please elaborate on what the issue seems to be with set a sides?

    How about some context?

    Your post before that one was ranting explaining how difficult it is to follow some thoughts.

    If, and it is only a guess, that statement is in your proposed draft order, then leave it as dd/mm/yyyy for the judge to fill in if he decides to use your proposed draft.

    You don't put a date - its left blank, or you state it as 14 days from the date of... - because you dont know when exactly all this will happen, you cant be precise as to a day. 

    Henrik wasnt tellin gyou to not performa  set aside. They were giving you examples on how to find out the info you need in order to get this Set Aside successfully sorted.
