Alos, he did say all information regarding customers who bought the shoes…
I think it would be inadvisable to hand over any of the buyers’ information voluntarily. What on earth do you think Hewitsons are going to do with it all? If they send letters to all 100 demanding the trainers be sent to them or a legal declaration that they no longer have the trainers in their possession, you’re going to have some very annoyed buyers. Ignoring whether they care they’ve been sold fake items, they’re all going to be upset at any expense and inconvenience to them. You were acting as a business. You’re bound by the Data Protection Act. It’ll only take a small number of your 100 to complain, and you could have the Information Commissioner’s Office breathing down your neck, as well as these solicitors.

You could offer to try to contact the buyers yourself. You should tell the solicitors to obtain any information on the buyers directly from eBay, as the information they hold will be more complete and up-to-date. The opposite to voluntarily is when a court orders you to do so. That would make it ok.

I used my sisters account to sell so it came in her name…
Reading through the posts, I couldn’t see how it could get any worse. Then you came up with this. Have the solicitors accepted that your sister is not in any way involved? In the worst case, she’ll be taken to court along with you.

I'll happily take the blame then her because it was me who was selling the goods not her. I understand what you are saying about passing on the buyers details as that will be opening another area of dispute up!

I could ask them to give me a letter in writing stating that if I provide the suppliers details (which is what they want!), they would not take the matter any further, I got the gut feeling that they might make me write them a letter stating everything as a form of confession and then use it against me.

I could use the supplier as the negotiating tool? At the end of the day thats what they want. I really dont know where to start looking for solicitors, they are not at work on weekends are they? called a few and they told me to either call back on MOnday as 'everyone is gone because it's Friday' or that they dont specialise in that area!

Isnt there a local advice centre or something like that?

Outrageous but sadly not uncommon, just because someone gets to university doesn't mean they can use grammar or spell proper;)

I can smell the same thing. I doubt such a thing can happen, epecially with the data protection act.

Also the op has failed to mention any legal terms he's just claimed Hewitsons has informed him to pay them money which sounds very dubious.

Plus where's the evidence? How could Hewitsons prove the seller sold knock off items, an ebay account can be hijacked, fake details can be supplied to ebay. Surely Nike will not use solicitors unless they had evidence that such an offence was commited, can you imagine the bad publicity they would get if the trainers were real?

While we're on the subject, i've been buying things off ebay for a friend in nigeria whos son is a missionary and was happy to pay £800 for mobile phones worth £50 for cash, but only after he has received the item. He seems to have been a bit forgetful with the paying for them part, and now i'm in deep trouble. It never occured to me that i was part of an international scam. Can anyone help me dig myself out of this too?

I got a letter from Hewitsons today saying that I should pay £25 per trainer I sold which is above what I sold them for PLUS £350 to settle the claim PLUS a percentage of something.

I have sold about 100 pairs and stupid me probably thought they were real as I now know they arent because nike say so, and they did come from China

    Please help!!!

    MKR

Sorry m8y, not feeling any big urges to help a scammer who has been selling counterfeit goods on ebay to unsuspecting buyers and is now bleating because he has got caught.

Be a good boy and take your medicine on this one, and try earning an honest living like the rest of us have to in future.
