    Sure, if you tell them your going to defend the claim then they might decide that it's not worth the trouble because you might win if it went to court.
  • well i would not use "slow internet speed" , as most companies say UPTO XXX , not guarenteed 

    I would say that talk talk broke there conntract by failing to provide a service , and would not release you from contact , even after you tried to negosiate , a proper service or allow you to leave and go elsewhere 
    although the claim belongs to another company now , it could get messy and akward for them

    To rewind a bit, it's not clear if TT have a legitimate claim. If you were in contract when you moved properties, that contract would have either continued or restarted a new minimum term at the new property. If you then terminated that contract early, you will be liable for early termination charges. If there is a problem, you have have to allow the provider reasonable opportunity to remedy the problem. Its not clear from your post what service you were told you could expect, what you got, what actions were taken and how long the problem persisted for before you cancelled.

    My contract with Talktalk started from April 2017, then because I was living in temporary accommodation my council moved me. So I had to continue with them due to move in January 2018. So when I contacted them to transfer the service  I dont recall telling me this would be a new contract. 
    I did want through with the technical team to fix the problem (no internet connection) but failed to found the problem. So I cant pay for a service that I am not getting plus I had to fix the problem rapidly due to my sons who needed internet for their homework.
    When I saw no solution then I decided to leave them. They offered me I think £30 off the early exit fees but I refused to pay more than 1 month charge of £27, especially when I have been with them since 04/17. 
    At one time, in few months later, they offered me to pay £50 by email, but when I checked my online account it wasn't reflected that amount. So be ause I couldn't trust them. I ignored them since then.

    Its still not clear how long you gave them to resolve the issue and what they did during that time. You need to consider that TT may have a legitimate claim against you if you unilaterally ended the contract.

    The letter of claim I received from BW legal states : on 19 Feb 2018, you entered into an agreement with Talktalk to provide you with an account. You failed to make a payment in accordance with the terms of the agreement and it was later terminated and has since been assigned to our cult on Jan 2020. Notice of this assignment has been previously been given to you.

    If I prove them the facts are wrong ie email leaving confirmation (early exit fees) that I left talktalk and a copy from my credit report that I was in the green. Should it be enough?

    My problem with TalkTalk is them claiming they are still providing service after I have moved to Vodafone (proved by faster service as moved to Fibre to the cabinet and I am receiving call charges on my new bills). However, nothing I can do convinces TalkTalk that they are not providing me with a service and they are still trying to extract money from me (I had taken the precaution of stopping my direct debit). They have form for this (look up cw_01051 on the Ofcom website, (the freephone number has been reassigned)). If you are having similar problems I suggest you copy this including quotes "Ofcom works to ensure everyone gets the very best from their communications." into the search facility on the Ofcom web site. Follow the first link. This tells you how to complain. If you are finding this difficult/impossible then...

    At least you will have done something other than hit your head against a brick wall and maybe Ofcom will reopen the case.

    I went through all the check with the technical team and they couldn't fix it. I requested them for a new router because I though the problem was that but they said it would be the same. I did gave them few weeks. 
    How they can have a legitimate claim when they gave lies to bw legal?

    I am reading this as you had an account with TT.
    You then broke your contract and moved ISP  and now TT have passed on this debt .
