BW legal letter of claim Talktalk

Hi everyone
This is my first time on this forum. Hope someone can help me. I have received today a letter of claim from Bw legal regarding my previous internet provider Talktalk. The letter says that because I didn't pay Talktalk they terminate my contract and own them £267.81. If I dont reply to the forms, they will proceed to make a claim against me in tha county court. Hence a CCJ.
I am the one who ask to terminate the account because my internet connection was rubbish to nul. I have been with them for a couple of years but because I moved house I transferred the account to new address. I haven't been told that it will start as new contract. Hence when I requested to terminate due to bad connection, Talktalk charged early fees to £267.81.
What do I have to do now with this threatening letter? My english is not the best and dont want to have a CCJ on my credit file. I read others threads but their were regarding parking fines. Please I need advice. I cant believe that even in the current national emergency we are in, they still want to do something like that.
Thanks in advance.

  • talk dont usually get BW involved , they (like other utility and credit cards) just send threatagrams then sell the debt to lowells or simular , not sure if tsalk talk have actually taken people to court

could be interesting , your mitigation would be thast they failed to supply a service (bad internet) which they no dout accepted but failed to remidy
  • PS what yr did you terminate the contact , and are you scotland or not

Talktalk sold the debt to JC international LLC who are the client of BW legal. I terminated the contract in November 2018. I live in England.
  • as the debt has now been sold , expect court papers

they are not exactly telling thr truth , " will proceed to make a claim against me in tha county court. Hence a CCJ."

1 they have to start a coourt claim with the correct info and facts
2: they have to actually win the case
3: you have to fail to pay the court "win" paper within 30 days

long way to go before before a ccj

pay it or fight it , choise is yours

Of course I want to fight it. My problem is how. My worry is if they see my writing is basic english they would feel confident to continue their aggressive way to get me pay something that is not fair.
  • your writing will probably be better than the indian writing on notes at talk talk , when you get them , the request is called a SAR

Thank you. So I have to request for a SAR. But I read in others threads that they usually dont reply with the infos (SAR). So should i still request it?
  • talk talk HAVE by law to provide any and all conversations / messages / enails BY LAW , if thy refuse they can be reported

its talk talk you want to address this to there DPO , you need to inform BW and JC international LLC that you are seeking legal advice and put this on hold

    Thank you for the clarification.
I just looked at my past  emails conversation with Talktalk and found the email confirmation that I wanted to leave them  hence the early exit fees of £226.20. Should I send a copy to bw legal and their clients to show them that they are in the wrong. So they stop stressing me about it.

When the court sends you a copy of the claim form you will have 14 days to provide your defence to the court (you can extend this to 28 days by returning the acknowledgement of service within 14 days). It's really important that you respond in time as otherwise the company can obtain a CCJ by default.
