    10 Posts First Anniversary
    There has been no   acknowledgement from the Claimant that they received the defence from the court . I phoned yesterday . Defence sent on February 28th . I was told they have 33 days to respond . I was advised to wait for the DQ from the Court 
    I have no idea when the Court sent Defence but I assume it was e-mailed on receipt 
    I have checked MCOL .Very little on it . Was told that if there was a stay CEL,would need to get a judge to agree to continue  
    Was wondering if there was a possible penalty on CEL for failing to response ?
    Of course the DQ is ready to send plus I can get ready witness statement 
    Should we sit tight now ?

    Why not file and serve your DQ - as suggested in the last sentence of my post a week ago?

    Claimants don't have to respond to a defence.  It is not mandatory.

    Assume the case is going ahead unless the court tells you otherwise, and follow the excellent advice you have received on this thread and in the NEWBIES.

    FWIIW, double dipping cases should be slam dunk winners for motorists.   
    You never know how far you can go until you go too far.

    Contacted Court . Was told that as Civil Enforcement Ltd have not replied to the defence it will be set aside . The will have to apply to a judge to get the stay lifted . The cost will be £100 .Wonder if this has happened to anyone else ? What is the thought on this ?
