    Received a court letter today.. gave reduction of £40 for fees so have to pay £215 ..
    also received a final notice letter from newlyn . Shall I put up the redacted parking ticket? Just waiting for a court date now .. will be grateful for any help thankyou

    Your order doesnt make sense at 4 - you cannot promise to serve a defence within 14 days of the date of set aside, becauseyou give them 14 days to send you a claim form! You should really state within 28 days of the set aside hearing -that gives you 14 days from the last dte they send you the form, assuming they do so. 
    Some reduciton is better than nothing. 
    Have you gone into court IN PERSON and asked for an emergency stay on enforcement? IF YES and it was granted, you need to INSTRUCT Newlyn to FRO with their letters, as a court Order blocks them doing ANYTHING until yo uhave a hearing. TO send letters while an order is in place means therye in breach of the order, and that can be considered contempt of court.

    Not been to court yet.. waiting for a date to go now as just need to pay the cost of set aside appeal ...does anyone know if i can go into court with my daughter as she suffers with anxiety . I will put up the pcn and ntk later thanks

    Yes you can go with her, either as a McKenzie Friend (where all you can do is give her moral support and help with paperwork - you can't speak), OR as a Lay Representative (where you do all the talking and she only responds if the judge directly asks her). In both cases she must attend the court.

    No, lay rep act covers it. 
    AS told, GO TO COURT. Dont wait for a hearing. That could be a month away. You do not have tjhe time to waste for that. Newlyn can attend any time they like, they CAN clamp cars etc and if afforded entry to the house can remove goods. Dont sit and wait. Get yoru daughter to WALK INTO COURT and get an emergency stay of enforcement. DO so WITH your set aside docs in hand. 
    If you havent paid yet have you filed already? IF not, then just alter teh 14 days to 28 days. 

  • Yes already sent witness statement draft and defence! Is it detrimental that did not put 14days?Paying on monday then have to wait for court date. Do not have the court papers just a letter from the court regarding the payment of the set aside. How do I ask for stay of enforcement we do not live in Northampton. Apparently she can go to a local court for the hearing when they give her time and date.

    The CCBC in Northampton is not a court , it's a government office staffed by civil servants
