if you google the county court in Northampton, its a different postcode than the CCBC, the BC means Business Centre, its no more a court than the DVLA building in Swansea, because all government departments have buildings that are all over the UKits an administration central office, just so happens they chose Northampton0

Hi regarding the set aside. Got a date and were hoping to have it via video. This was rubbish as had to log in and check if laptop compatible. We thought it was fine but they have decided she has to attend court at the end of April as they said connection was not good but think it was from their end as we could see everything perfectly.
she is going to appeal as does not want to go to court in the current climate of corronovirus .She would rather do it all via video.
What we need to know is should she write to Gladstone's asking for the dates and copies of the court correspondence as they must have sent court letters etc to her previous address? She has received 2 parking notices that were sent to her previous address apparently although of course she never received them. But I presume they would have informed her that they were applying for a court hearing so she could defend herself. Would they also have sent a letter to her informing her of a ccj at all? Not sure how it works. She received this from gladstone's as we asked for a restriction of data processing and the case to go on hold as advised on here ...
received this back
"we refer to your request regarding the restriction of processing of data. Unfortunately we cannot process your request because we can demonstrate compelling legitimate grounds for the processing of your data which override the interests rights and freedoms of you as an individual, that legitimate interest being that we are acting on behalf of our client for the recovery of monies relating to a unpaid parking charge notice. To process your data is necessary and lawful as it is required for furtherance of our client's instructions and we act for them on their rights and obligations for the recovery of such monies.
As court proceedings have now been issued we are obliged to follow the court process which includes adhering to any deadlines or directions set by the court."
not sure what any of this means really.
When she appears at court does she have to explain what she would have done if she had known about the parking ticket ie appealed or paid it?
She would have appealed as it was right before Christmas and her overstay was 23 minutes. The car park is mad at Christmas as you queue to get in and queue to get out!
Also does she have to send anything to court as evidence prior to the hearing? thanks guys

All letters from the court should have been copied to you. For all other stuff send an SAR to the Parking Company

I already asked horizon for the parking fines they sent me so I could see why they gave me a pcn. It was because 23 minutes overstayed in the car park.
i will ask gladsones for the court papers sent. Thanks do much.
just need help on the appeal in front of the judge and what will happen etc0 -
lready asked horizon for the parking fines
They are not fines, surely you realise that by now
i will ask gladsones for the court papers sent
Why, have the court not sent them to you?. Did you not read my previous post. sent at 9.17 this morning?
just need help on the appeal in front of the judge and what will happen etc
What happens is all available in the newbies and by using a search engine. Do you really want to fight this? If so you will have to raise your game, there is only so much we can do. Have you complained to your MP?You never know how far you can go until you go too far.1 -
Thankyou.
She has no court papers just a date to ask for a set aside via email. I meant copies of any court letters from anyone ie Horizon or Gladstone's telling her they were applying for a ccj and she could go to court to fight it. Obviously she did not get anything as she had moved address. Just thought she should ask for copies to prove they were sent to a previous address, Sorry I do feel a bit out of my depth and coupon mad said
"OK, so you are at set aside stage waiting for a set aside hearing, yes?
While it is quiet, show us what you submitted and we can help you prepare for the hearing."
so that was why I was asking for help.0 -
Obviously she did not get anything as she had moved address.I've not trudged back through the thread to check, but has a 'Data Rectification' notice been sent to the PPC and solicitors telling each of them the new address, to which all further correspondence must now be addressed, and any former address should be expunged from their records as required via the DPA and GDPR requirements.Send the emails to the Data Protection Officer via each organisation's website Privacy Page (sometimes a subsection of their 'Contact Us' page). Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If you have (had) a date for a set-aside, presumably you have submitted a six-point draft order and witness statement, in which case you use the witness statement plus any defence points (probably have a defence in your back pocket) to help answer any questions the judge will throw at you. Remember that it is only a hearing about getting the judgment set-aside and not the original case, although some judges require you to have a "realistic prospect of being able to defend the original claim."0

Op - you need to
- call ccbc to get a copy of the CLAIM FORM.To the solicitors you also ask.You seem to not understand what docs are sent and when.0 -
yes Gladstone’s sent a email stating they confirm the carried out rectification of the address and what claim form do you mean? Thanks0
