I've not agreed to this, I'm just stating the letter I've received today. I didn't even know you could just go paper only I am looking over the newbie thread and I am reading the updated thread in regards to the telephone hearings but I'm still not quite getting it. I don't see how to argue against this and go for telephone hearing?Coupon-mad said:
Obviously not OK.Piffpop said:Just a general update, I've now received a letter confirming dates for my WS and documents to be in by 23/09, the claim is listed as 'paper disposal without hearing' on the 19/11.
You have objected and said ''no'' because you don't want to lose...of course. If you don't understand why a paper hearing is an ABSOLUTE NO-NO, then you aren't following our advice and have gone so far off piste that you risk losing.0 -
Isn't there a draft letter to use in the 'Telephone Hearings' thread?Piffpop said:

You were not told to read the NEWBIES thread for that:
Here's some immediate advice - do not agree to a hearing on the papers, the chances of losing are much, much higher that way. Since the greater use of the method we have only seen one successful case, but many more unsuccessful ones.
!Please read Coupon-mad's 'Telephone Hearings' thread which will explain in detail why you don't want to go down the 'papers' route, and how you should respond to the court to get this to a telephone hearing as a minimum, but ideally a face-to-face event.

Oh my goodness, it's more I had to go through the entire thread to reach that point and was utterly confused by why you all kept pointing me to a thread that states 'telephone hearing's when I'm not up to that point. I appreciate the help, I finally found Coupon's response with their draft.Umkomaas said:

Though I appreciate your response, no one said NOT TO. I saw the link to the telephone thread and then Umkomaas kindly also stated to go to the telephone thread. I didn't realise your kindly laid out draft was on page 14 so I was confused as usually they're pinned to page 1.Coupon-mad said:You were not told to read the NEWBIES thread for that:Here's some immediate advice - do not agree to a hearing on the papers, the chances of losing are much, much higher that way. I know, sorry if I've agitated you into thinking I've not read anything, I am reading but didn't realise your response was so much further in, maybe mention to people to read the entire thread for it to make sense.Coupon-mad said:We are not allowed to pin all threads to page 1, sadly!2 -
Lots of threads develop and evolve over time and uncontrollable added comments extend them, at times almost exponentially. Regulars are dealing with dozens upon dozens of different cases, many involving complicated pieces of contract law, legislation, court procedures, every day (quite often over 100 in 24 hours), so sometimes it's a case of a vague recall (maybe a dim light bulb illuminating somewhere in the back of the mind) of something that might help a poster, leaving them to do the search and fully explore the direction in which they are pointed. If we had a 'sticky' for every bit of contemporaneous advice (and things change so rapidly in this game) the first couple of pages would be swamped by 'stickies'.Piffpop said:

The reason of NO PAPERS is simple ...... you have lost your voice which you need to question points for the judge to hear and remind him/her of your defence.
One easy way to reject "papers" is to say you wish to question the claimant regarding the unknown amount of £60 ???

Parking firm solicitors do 'papers' for a living. You don't.
You want to be heard as a real person to call out their evidence that will otherwise look like it ticks all the boxes.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
