    Agreed , I did tell you this earlier

    Proof of payment by app or phoning is not proof of receipt by PP

    All it shows is an intention to pay and actions to do so , but failure to ensure that the fee was paid to PP and a second failure of not trying to sort it out properly when the PCN arrived

    PP expected to see payment in their account , it did not arrive , subsequent letters were ignored

    I believe that PP will issue a court case in due course , after they reject your appeal

    If you are looking for an easy way out of this , there isn't one

    Ok so I can’t appeal with premier park as it won’t let me do so on the website as they’ve transferred it to their debt recovery agent. But I don’t think the letter I received today is a LBC as it’s only giving me til 28thnov to pay and doesn’t have reply forms. Should I still request a SAR?

    you could send them a letter of appeal by royal mail,if you wanted to

    no it wont be an LoC , but you could email a SAR , if you wanted to

    if they complied with POFA then not being the driver is irrelevant , they can hold you as keeper responsible using POFA 2012

    if they failed POFA , then as keeper you have no legal liability, so check their postal NTK for compliance with POFA

    They complied with POFA. How do I actually say that I thought I had paid it, do I amend the generic appeal to explain this? Should I appeal and request an SAR or will that go against me? Sorry to keep asking, my husband thinks I should just ignore it but now that Ive realised we didn’t actually pay I’m thinking otherwise

    They would pursue you as registered keeper unless you name the driver now.

    You will be sued, then, if you ignore private parking tickets. Ignoring these is something we did back in 2012, years ago!

    They can't get £160, not even in court (as long as it was defended well) so no paying.

    Who would be best defending it in court?

    Probably me although I’m not sure I can deal with the stress of it, do you think phoning and explaining and agreeing to pay the original £60 or £100 would get me anywhere

    If you are going to make an offer as registered keeper because you can't see any defence, put it in writing by email, and head it up:

    WITHOUT PREJUDICE SAVE AS TO COSTS.

    Court is not that stressful you know.

    Is thinking I’d paid but only just realising I haven’t a good defense tho? I would like to try but I don’t understand how the appeal template will make sense at this point?
