Vehicle Incorrectly Seized
I applied a private plate from DVLA and notified my insurance on 11/11/19. On 13/11/19 I was pulled for no insurance and no plate. Police didn't even give me the opportunity to show documents and seized my vehicle even though it was showing insured on askmid and I had all my supporting documents. They now have sent me 6 points and a £300 fine and i have opted for a court hearing. My insurance has investigated and so have DVLA and now i have evidence everything was done on my side and their side but the police computer database was slow to show the changes. I have since then had an article on The Sun
Now i want to go to court to be compensated and reimbursed and get my points and fines cleared.
My question is, how much can i claim in compensation for all of the above? How do i proceed?

I have my logbook stating that the new plate was in force from 12/11/19 and a final report from Admiral proving the transfer of insurance and to the MIB was instant also on 12/11/19
I was pulled over 36 hours later on the 13/11/19
If i was driving with my old plate and allowed 7 days as they advised on The Sun, i still would have had been seized as the old plate was no longer insured either as it was transferred. It was just the matter of the police national computer database being slow at updated.
I wasn't even given the opportunity to show documents! Completely against the Road Traffic Act they quote to the newspapers.
They are ignoring my emails since i chose to go to court and arent responding since i told them i have the evidence against them.0 -
I hope after that (which I think you should win form the info you provided) you get charged for illegal number plate spacing if those in the sun are correct.0
-
I wasn't actually aware at the time of ordering that the spacing was illegal (my mistake) and the police officers that pulled me over didn't mention anything about the spacing either. I'm in the process of sorting this out and arranging for new plates now.
The court matter is about no insurance and the registration not showing.
I don't think the spacing is relevant in this specific case but it will be sorted ASAP.0 -
I assume this is the story.

So your loss is a total of 321 quid, would that not be what you can claim?0

I have done nothing wrong at all and feel as i was racially discriminated.
Since i have obtained and investigated to conclude the required evidence to point blame at West Midlands Police, they have stopped replying to my emails as the only method of appeal to the Vehicle Recovery Unit.
Now i want to go to court to be compensated and reimbursed and get my points and fines cleared.

You could try a solicitor or may be your first step could be your local Police and crime commissioner, each area has a different one.

The police take their registration data from the DVLA and the insurance from the insurance database. So it wasn't their database that was incorrect.
I see the sun has somewhat embellished the story to make better reading.
Before you drive again I'd get some legal plates.0 -
Having had a somewhat similar situation (car correctly registered to me but insurance amended by insurance company to wrong model/registration) - stopped by Police, spoken to nicely, given 7 day producer with suggestion that I got letter from insurance company explaining situation.
All handled nicely with no 'attitude' from either party - they'd have been within their rights to seize but chose not to, I didn't challenge in any way.
We only know one side of the story - the fact it's appeared in The Sun gives some clue to the OP's attitudes
Good luck in the compo quest :rotfl:0 -
What is the private plate meant to spell out?
Seems a waste of money to me.Thrifty Till 50 Then Spend Till the End
You can please some of the people some of the time, all of the people some of the time, some of the people all of the time but you can never please all of the people all of the time0 -
Several legal initial legal consultations have told me that i can claim back the stress it has caused me alongside the time it has consumed?0
